Like say anything set in Middle-Earth that was not created by Tolkien, any Spider-man comic not written by Lee and Ditko, any Mickey Mouse movie that Walt Disney himself didn't make. Is it all technically fan faction?

Sometimes not even then. Rowling's new movie series might as well be fan fiction to a lot of people as it sucks & has all sorts of plot holes & things that contradict the books (canon to the hardcore).

It goes by whoever owns the IP, but technicalities like that are of little consequence and everyone is free to accept whatever they want and reject whatever they want.

For example, nobody has to accept Indiana Jones 4 just because it's official lol. I'll never understand why people can say a sequel ruins earlier installment. No it doesn't, lol. Just ignore it.
