I've heard it's because of differences in strength. So, if Xena Warrior Princess and Ben Boykewich have sex while both are drunk, Xena is the rapist and Ben is the victim.

If it's a man and a woman the man raped the woman.
If it's two men they raped each other. If it's two women no one was raped.
