how is shooting a man in the back a justified shooting? he was armed only with a taser that had already been fired and was used up. and also cops call tasers non lethal. so make your mind up cops. which is it? are tasers lethal or non lethal. but if you want to argue "what if he tased the cop and stole his gun" that didn't happen. he had abandoned his tase the cop plan and was running off with his back the cop when he was shot

Was this the same state where the two rednecks chased down and shot the black guy? IIRC people said that would be considered legal in GA because he swung at them or something. If it's legal to fight back with lethal force, then he's not getting charged.

The DA for Atlanta pressed charges last month against a couple officers who tasered someone inside their vehicle. The DA charged them with Aggravated Assault, which requires either assault with a deadly weapon or some kind of serious bodily harm--In this case, the DA argued that a taser was a deadly weapon.

Now, granted, I totally agree with the charges here, but the problem is as a DA if you start picking and choosing when a taser is considered a deadly weapon, you're going to give the defense a lot of room to pick apart your inconsistency. If the taser was a deadly weapon, and it was fired at the officers, in the moment they would be justified in using deadly force even if the suspect was actively fleeing.

I doubt these charges will stick tbh.

Dude, just cuz some of us support cops doesnt mean we agree with every fuckin thing they do.

He didnt need to shoot that man at all, he deserves manslaughter charges. Cant fuckin blast someone just cuz theyre getting away, they had his info. Let his drunk ass run off and arrest him later on escaping too, he didnt have a lethal weapon .

I agree that his prior charges are completely immaterial and it is bad form to even bring them up.

But they'll definitely come up in court. Probably in the context of look how polite they were being despite the victims record, and that hed probably do a lot to keep from going back to jail.

but at least based on an earlier CE discussion, felony murder is the default charge for this scenario in georgia law
