Okay, but shes UNDER arrest. And needs to have a search conducted. Like no shit shes not comfortable, nobody is when theyre under arrest. He doesnt search her. she pulls out a gun and shoots herself(this exact scenario happened In my department) then you guys are outraged and think the cop did it. except as stated hes not feeling up on her private bits at her. He starts in the middle of the chest not touching her breasts and is barely

Obviously he should have just kept her facedown on the pavement until a female officer arrived to make sure that it was safe to transport her or move further with the arrest. Who cares if it took an hour or more, there is no reason to ever search her.

Source needed that it'd take an hour for a female officer to respond.

With the exclusion of removing clothing or a cavity search, it seems pretty silly to think that they'd need to heed the request for a female officer for something so basic. I don't know if just casually doing the search without informing the person in custody is proper form or not, but outside of that I don't see any particular issue. I'd feel that proper decorum should be an explicit statement of what and why he's going to be doing that, but maybe safety regulations say it should be done immediately.

Which is the smart and correct thing to do.

Iffy.

When conducting a search its common practice to check as much of the body as possible. People have apparently hidden things under the skin between their fingers, for example. If people could go to those lengths, she could definitely be hiding something under her breasts or in her bra.

That said, I was under the impression that, if at all possible, youre not to conduct a search on a member of the opposite gender, for exactly this reason. Even if he wasnt trying to assault her, thats what it will come off as.

If an officer needs to conduct a search on a member of the opposite gender he/she is within their rights to do so, but they use the back of their hand for the pat down (which seems to be what the cop is doing in the video), so it has a lower chance to be misconstrued as groping.

Its hard to get much context from the video, though. I dont know what happened before the video starts, but he seems to start the frisk on her breasts, which is pretty odd to say the least.

Ive been to plenty of concerts and sporting events with girls and I can tell you they fit a lot in there. Some girls had a whole mini bar in there.

Lots of girls hold their cell phones in there as well. Shows an example of at least the size of stuff that can go in there, but also shows that its tough for cops to tell if all they see is a bulge. Could be a bag of weed or could be a pack of smokes and a lighter.

Maybe making a female backup a requirement, in situations like these. I know plenty of times Ive been pulled over they have a 2nd car pull up so I know they have some just ready and waiting.

Even while I was still there things had been changed that females only do females and males only do males. I'm not trying to defend him as he violated her rights by refusing to get a female officer when she asked for one, but the way in which his hand was positioned it was not him "groping" her.

I travel to between 3-4 countries a year for work. The only country I have ever had people grope me when allegedly checking for dangerous items is the US, the country I happen to have citizenship in. Not even the PRC has felt the need to touch my junk before.

So yes maybe this is the right way to do the breast check or whatever, but it's a question of why? The US has the highest prison population in the world both by numbers and percent. No first world country, and even most third world countries have as high a rate of police killings either. The US for as much as it talks about freedom is a police state in many ways. I actually forgot about the stupid water rule last time I was in the US and had to toss my drink out going through security.

Thats not a violation of a right. Thats not a thing. Most departments will accommodate the female if they have can. Most times they cant. My shift consists of two squads of 8-10 each depending on who is on vacation. It covers the biggest square feet area of the entire city. Theres one female during that shift. Its near impossible
