thinking about just doing a stake out for the rest of the week from like 1 or 2 AM for about an hour to see if I catch anyone. now here is where I need advice lol:

if I was to catch one of these fucks in the act and beat the shit out of them with a bat... is that considered assault?

Yes

1. They didn't enter your house, just your yard, so thats trespassing instead of breaking and entering

2. They didn't physically threaten you

3. You may be allowed to threaten or even swing once or twice....but if you just keep wailing, especially after they are down, that is aggravated assault

I guess beat the shit out of them was a bit much, but yeah Id like to just get off a couple of swings and then get the cops involved. they got into my wifes car about 2 months ago and now mine last night. thank god were moving soon
