Because what they posted was not incorrect. It is illegal for a business to ask an individual what their disability is in regards to the law. Because of that you cannot assume they do not have a disability either.

The issue here is that the majority of the people here do not know how to counter this point because the majority do not fully understand what the law is behind ADA and what it means to be in compliance with it. Note that the users similar to who I responded to either don't fully understand the law themselves or are purposefully ignoring what it takes to be compliant with accessibility.

The point I want all of that to follow into is that refuting this is trivial to do. I am rather concerned that others want to outright remove posts like this instead of doing the easy counter which is far more effective. Accessibility isn't about masks this and anti-masks that; it is about resolving issues where disabilities hinder people from performing tasks that abled people can do. It is this mindset you need for this entire topic and what the intended tone that ADA was written for. This is something I deal with at a professional level on a near daily basis so I've plenty of experience on what is and what isn't allowed in regards to compliance.

In the counter I provided, ADA states that you are allowed to provide alternative services to fulfil when the barrier to the main service cannot be feasibly overcome. Taking this further with the original OP, they did provide the alternative service which is the drive-thru where you can feasibly not wear a mask and still get your stuff with minimal contact with others. The fatal flaw of the argument is the motorcycle bit: owning a motorcycle is not a disability nor is it assistive technology and because of those, it cannot be considered as a necessity for accessibility accommodation. This person will need to procure a vehicle that is able to utilize the drive-thru or find another business that accommodates motorcycles (viva la free market).

ADA doesn't cover any of that, you're thinking HIPPA, which only covers medical personal and insurance companies. I can legally ask anyone why they can't wear a mask, they don't have to answer me though.

ADA says we have to make proper accommodations for anyone with a disability. If someone "can't" wear a mask, we can offer them a faceshield, if they refuse that we can offer to shop for them or they can shop online and get curbside pick up, if they refuse that, we can legally ask them to leave the store, if they refuse, we can call the police and have them trespassed.

Something the "mah rights!" People don't get is that business are private property, we are legally allowed to refuse service to anyone as long as we are not refusing that service based on a protected class(race, sex, creed, so on) if you refuse all alternatives presented to you, you are making it legal for us to have you removed from the property.

if yours is anything like mine, you won't have any problems. PA has had mandates for more than a month. Walmart has signs stating they're following the mandate. 30% of the customers and maybe 90% of the staff are wearing masks correctly. i literally followed a guy in last week who took a disposable out of his back pocket, pretend to put it on while walking past the outside employee, and then put it back in his pocket as soon as he was inside the first door.

I have no fucking words left.
