Do you think the 25 y/o rider of that machine should be charged for not seeing the sleeping kid in the field?


13 y/o Jeffrey Powell from Michigan was DEER HUNTING when he was horrifically killed after he fell ASLEEP waiting for deer that never came by and suddenly a CORN HARVESTER came by and ran him over!!

It happened just before 9am in a rural cornfield in Chandler Township as Jeffrey had been DROPPED OFF at the field so he could go hunt deer and then when he didn't find anything he had apparently fallen asleep.

A 25 y/o man returned to the field to finish harvesting not knowing anybody was in the field and drove a large Krone Corn Chopper and over a sleeping Powell only realizing what he had done a short while later.

Emergency Workers declared him dead at the scene

The powell family said Jeffrey died what he loved doing...hunting.

The 8th grade student was an avid hunter, fisherman and archer and a state champion in the middle school archery team.

His dream was to go big game hunting later in life in Europe

His former teacher said he LOVED Science and anything to do with NATURE

He enjoyed playing online with his XBOX One and was excited to get the new XBOX Series X for Christmas according to his family..

Do you think the 25 y/o rider of this vehicle should be charged for not seeing the sleeping kid on the field?

I could believe that being surrounded by corn muffled that noise to enough of an extent that it didn't wake him up until it was quite close, at which point he was too disoriented to get out of the way in time.

Most farming accidents like this I've heard of in Canada have generally just been accepted to be tragic accidents, unless there was clearly some sort of gross negligence at play that would warrant manslaughter charges.

This is an unfortunate accident. I would not be surprised if he faced some kind of charge, but it's very likely he faces the minimal sentence if he does.

I think a lot of this will come down to the fact it was private property, and not open hunting grounds.

Still sad to hear though.

That's probably the biggest mitigating factor. The driver had absolutely no reason to suspect that somebody might be sleeping in the field he was harvesting, and therefore no reason to scout out the area before beginning to work (at which point he can't have been expected to see the kid lying down because visibility in those machines is quite limited). Were it a public area, he'd have more responsibility to ensure the safety of any bystanders because he could reasonably expect to find somebody.

Unless the kid was 10' tall, this is just a tragic Darwin award level accident. There was no reasonable expectation on the part of the farmer to expect a child sleeping in the middle of his crop. It's a shitty situation, but I see no crime under the circumstances.

The farmer is probably scarred, too... But this is pretty sad. I dont think he should be charged. Not only was visibility probably not good in the machine, but the field was probably pretty high since he was harvesting. So, he probably wouldnt have seen him, anyway... I was wondering how they found out, but when he went back the other way, he probably noticed...

Pretty much this.. I mean there should be an investigation of course. And see if there was any way of knowing he knew the boy was there. I don't think he should be charged though...how often do you come across somebody out of the blue when your doing your job until it's too late to do anything. If anything here, it was just a mere freak accident that happened. I'm sure the harvestor is gonna need many years of therapy.

No. There's no reason why a 13 year old should be sleeping in a corn field. There's no reason a farmer should have to check his cornfield for random people sleeping in it. Incredibly sad, but the farmer should face no charges at all. The trauma from that is going to be with him and shape him for his entire life. His life will never be the same. You shouldn't add any more pain to that.
