They are criminals who are being punished for their crimes. No punishment is going to be nice. They should've thought of that before they committed the crime

Not all crimes are equal, not every person is treated fairly in court, and the judicial system has been proven to be flawed for literal decades now

For this argument to work you have to assume that the justice system is perfectly fair, perfectly impartial, incapable of being wrong or too heavy handed

You also need to assume that all criminals are evil people who flaunt the rules because they hate you

In other words you have to lie

Here's a true story for you guys.

A 15 year old is standing in a council estate (ghetto for British people) when a known local gang member walks up to him, thrusts a bag of heroin into his hand and says "hide this. I'll be back for it later. If you do anything with it I'll fucking kill you and your mother."

The police, arriving shortly after this exchange and who had been on the tail of this bag of drugs, tracked it down to the teenager. They arrest him for possession and put him on house arrest while it goes through the courts. In the end it was agreed that it wasn't his and he was cleared on a lesser charge of possession. The police were no help in protecting the kid from the gang.

The drug dealer returns to the kid and tells him that since he's lost his stash of drugs he now owes a debt. This time, he gives the kid another bag and tells him to sell it, and keep selling it or else he'll find his mother dead in the bathtub.

Remember, this is a dirt poor, uneducated 15 year old with no support network or role models and already facing a negligent police force that doesn't want to deal with it. The only person he has is his mother. And frankly, she's just not all there.

So he desperately buys himself a gun for protection thinking his life is in danger and tries to wait the situation out. Only this time, the police break down his door and find the drugs and a gun.

So, intent to sell class A drugs and possession of an illegal firearm. He faces 15-20.

The ONLY reason I know about this story is because I know the social worker who's job it was to argue on his behalf.

If we all listened to you, we wouldn't have any need for social workers, because we'd just agree that the kid is the scum of society, right? Don't want the crime, don't do the time, or some nonsense

A sane person could look at that story and realise that if someone had the help they needed to get out of a bad situation then a whole lot of injustice and cost to society would have been avoided. After all it's not just the kid who pays. It's you, and me, and everyone else who supports a system that puts people in prison regardless of circumstance.

It takes a huge degree of short sightedness to think that incarceration is automatically justice.

You think your life is on the line and you think a gun will solve the problem, you'll find the 500.

Look dude you can just accept that grooming and exploitation is a fact in the drug trade or you can examine my anecdote for things you find hard to believe, point works either way.

(And yes, it's a real story. Not an uncommon one either).

A prison system that exists solely to punish only ends up creating life-long prisoners. Without a focus on rehabilitation, prisoners aren't going to learn productive life skills. When they leave, they'll be in no better spot than when they went in, now they are just years behind and a criminal record making it harder to get a job. So they are more likely to revert to what they know. Crime. They get caught, end back in the system and repeat.

In addition a prison that cannot provide a safe environment for its inmates only encourages folks to feel like they need to join prison gangs. This further ingrains them to a criminal life style and makes what little reform efforts the prison has even less effective.

So even ignoring the fact that these are human beings who should be treated with basic human dignity by their caretaker. There is obvious logistical benefits to actually having a prison system based around safety and reform.

No, that SHOULD BE THE POINT. However throwing somebody with a drug problem in cage for years while providing the bare minimum is not rehabilitating anyone, it's just punishment.

It's adult time out, but it's years of time out where you will probably get beat up by guards and stabbed by another inmate who is actually dangerous and should be there.
