19 y/o Trigger Happy Freak, Justin Ray Boersma is facing FIRST DEGREE MURDER charges after a confrontation at a STARBUCKS when 31 y/o Samuel Joseph Rosseti confronted the teen for CUTTING in front of him at a drive thru and then got out of his car and pounded on his window and ripped his door handle off before walking off...that's when the teen took out his gun and SHOT him from behind 3 times and killed him.

It happened in Lake Worth Beach, Florida at noon when Justin cut in front of a truck with his Nissan Versa at a drive thru according to witnesses.

Samuel then got out of his black chevy silverado and walked up to his car and started banging on his car window and ripped off the handle of the door before walking back

Boersma said he was in the car with his infant child and girlfriend as the gf was screaming "We have a baby in the car"

Boersma then armed himself with a gun and got out and SHOT him 3 times at Rosseti's back and then DRIVING AWAY.

He told detecives he was worried for his family's safety and STOOD HIS GROUND.

But after Justin drove away when he shot Rosseti dead, he hit another car along the way and later said he fled so he could call his LAWYER before surrending.

The arrest report Boersma did not see Rosseti with a weapon as deputies and a citizen tried to administer CPR on him and he was transported to St. Mary's Medical Centre but they could not revive him.

Neighboring businesses had surveillance cameras but footage has not been released as police were able to track him from his license plate where they found a handgun found in a plastic bag under the child's car seat

The man driving the car, who was not Justin, pleaded ignorance about the handgun and said it didn't belong to him but the caliber matched the shell casings at the scene.

In total 5 people were in the Sentra including Boersma, his gf and their child.

A criminal defense attorney, Patrick McKamey believes Boersma may have a case under Florida's notorious stand your ground law who said "I think this is a case actually built for Stand your Ground. It looks like a GREAT cse and i've love to represent him. The defense can reasonably argue, it's unreasonable to think that if he's not in fear for his life or the life of those in the vehicle, why would somebody with an infant in the car go out and start shooting"

Roseti leaves behind a family of his own including a FOSTER SON.

second, why do people cause confrontations about the dumbest shit. You got cut in line at a Starbucks. Does it really pay to get out of your car in road rage and try to break the windows in?

this. someone walking away does not possess a clear danger that could be a threat to your life, which would be necessary to be "standing your ground". It's obviously not okay to assault a vehicle over something so minor, either, but by the time he had turned around any danger had passed for the moment.

They cut the guy off AND he felt the need to escalate things further by shooting him repeatedly and killing him after they couldn't handle the guy getting mad, getting out his vehicle and trying to confront him because he was full of road rage. "Stand your ground" my ass, this is a case where the murderer thought his ego was more important than another man's life, because he cowardly gunned the other guy down after he turned his back and decided to return to his vehicle. Straight up premeditated murder is all this is.

Yeah. Not even cops can shoot a fleeing criminal in the back and get off scott free unless the criminal is armed with a deadly weapon and they plan to use it beyond reasonable doubt or already have.

You would have to prove somehow that you thought he was coming back to harm you and you genuinely feared for your life.

Like if the guy said "ok motherfucker I got something for your ass, I'm getting my pistol" then MAYBE you'd have a case.

You're right, but it kind of is calculated, because after he got pissed that the other guy would dare to step up to the vehicle he waited for him to stop raging and to turn and start on his way back so he could shoot him repeatedly to kill him.

Somehow during that story it changed from a Nissan Versa to a Sentra.

How upset Id be if somehow tore off my door handle would depend on which type of car I owned.

Someone could still be a threat when walking back to their vehicle after a road rage confrontation because they could possibly go get a weapon and return or worse pull out a gun, aim and start firing it. Regardless this doesn't give anyone the right to attack and / or kill that person with a deadly weapon of their own preemptively, unless there were other very specific circumstances, and even then things may not go your way in court. In this instance the shooter is egotistical cold blooded murderer and is guilty as hell.

Where's the poll option that says both parties contributed to a tragedy that could have been avoided? This is the risk one takes when executing road rage. Maybe the other person has a gun. That said, buddy had already walked away, so I don't think stand your ground laws should apply to that. This looks more like anger and revenge fueled his actions, not fear.

It's always amazing how some people can turn what should be a normal pissing match into murder. Without some kind of underlying mental issue, the shooter definitely seems like he must have wanted to kill someone and he must have figured his poor understanding of the law would have been enough to get him off scot-free.

He shot the guy after the "moment of danger" had passed. Then fled.

Then he hit another car, and fled the scene from that.

He didn't stand his ground. He does the scene of a crime, and then fled an accident.
