I completely agree. He should have been impeached for both of his trials (honestly he should have been impeached more than twice). But a political trial and criminal trial should have different bars. a political appointment should be a privilege, and therefore should have a much lower bar before deciding you are unfit to serve a position of power.

But a criminal matter is different, and the US puts a huge amount of emphasis on the fact that you can't be incriminated for your speech without very extraneous circumstances, and as long as someone can argue that

No, President Trump never explicitly say to storm a riot. The rioters acted on their own and only they are responsible and guilty.

The criminal system doesn't really have a place to judge them. In fact the courts tend to bend over backwards to protect your freedom of speech.

He can be incriminated for a billion different things perfectly fine (probably a dozen different things he did on 1/6 itself) there's no need to incriminate him for something that (like it or not) probably would fall under protected speech.

Heck, Trump has already been through this, this isn't the first time he's been charged with incitement

Yeah, I'm so sure that's what he meant.

I doubt it but the point is he's got a defense. and that's more than enough to protect his freedom of speech, which is probably the most protected right in America.

He's guilty morally and logically, but that doesn't always equate to criminality.
