It says he was shot while holding the gunman's rifle, which means the gunman was down and the officer most likely did not see this guy actually shoot him. So the officer comes upon a man holding a rifle, but it wasn't the shooter so presumably he wasn't pointing the rifle at officers or bystanders, wasn't actively firing at all. And since he wasn't the shooter it seems pretty likely he would have surrendered quickly if the officer verbally engaged him.
