So apparently before Riri Williams was introduced into Marvel Comics as the inheritor of the Iron Man legacy, the Japanese had already created a porn parody of Iron Man called Ironheart. Oh, and what was Riri's superheroine name again? Oh yeah it was Ironheart. LOL. Disney clowns themselves again when they introduced that they are doing a Disney+ series for Ironheart. Can't believe they will finally be putting porn on a mainstream streaming service.

See the problem there is that if they try they wouldn't because the Japanese porno was made in 2014. This is at least two years before Riri was created and Joe Quesada (Marvel's Editor-in-Chief at the time) would have known about the Japanese porno and said that no one will ever figure it out and yet the media knew it immediately and even warned Marvel about this but Joe being Joe flipped them the bird and used the name anyways. So, no, Disney wouldn't at all. If the producers of the porno wanted to they could drain Disney of tons of money and possibly become the richest porn makers on the planet.

And it doesn't matter how much Disney fights when the evidence is in black and white, clear as crystal. Disney wouldn't win. It would be fucking hilarious to see them wasting all of their money trying though.

True but copyright is copyright. Once it is established it can't be broken, besides I'm pretty sure the judge would side with the Japanese company since the trial would take place in Japan. This is one of the few times I would be happy that the copyright system is a thing because it would destroy Disney. Disney being the company to happily attempt to murder the fair use doctrine would be obliterated by this lawsuit and we would all be better off for it.

Scarlet beat Disney. And had way less of a case than this. Think she ended up getting $60 million when the movie only made like $400M, and had Shang Chi to prove what happens when you do a theater-only release in the COVID era.

She had a pretty iron-clad case. Her contract said theatre-only. They did a streaming release and refused to renegotiate the contract to ensure she got her fair share from that. They breached the contract, she collected what she was owed. Very straightforward.

Had she not tried to renegotiate to account for how unfeasible a theatre-only release would have been, she might not have a case. It could be argued that there was reason to presume that the original plan of theatre-only wouldn't go ahead, and that her failure to bring that up meant she was okay with whatever that meant for her cut. But she did, and they refused, so I have no sympathy for them.

Yeah, if the comic's been around since 2016 and the porn producers haven't tried to protect their trademark, there's a pretty good chance Disney will be able to cite that as them giving up their claim to it and squash the whole thing.

I have a sneaking suspicion that Scarlett Johansson can afford considerably better lawyers than a random Japanese porn producer can, or at the very least isn't going to be so afraid of the prospect of having to pay Disney's legal fees if she loses that she'd avoid suing. That's not something a small company is going to be able to absorb easily, so even if they stand a decent chance in court (which, given their failure to object when the comic came out, is a stretch) it's unlikely they'll even try.
