This guide--which included cool 3D dioramas of each of the levels--was only released in Japan in 1996 and has not been available for sale through official means since then. But Nintendo still felt it within themselves to have it taken down from Internet Archive.

This. I'm tired of people using the "they're within their legal rights" excuse for everything.

Fuck their legal rights. If they want people to pay for their products then they need to make them readily available on demand regardless of what it is people want to buy.

It's more that companies with a younger audience does this. Disney, Viacom, and Hasbro off the top of my head are well known for this as well. Disney is actually the reason how copyright laws are the state they're in.

That's why I said from a legal perspective.

They want to protect their brand and copyright and don't want to make exceptions.

Ever seen The Room? It used to be on Youtube for free. For years (I think a decade)

Then someone made a documentary on the Room which featured clips of the movie. Tommy Wiseu sued them for copyright violation since it showed clips from the movie and one of the biggest legal arguments against him was the fact it was on Youtube in its entirity for free for years and he didn't care.

He lost the case and had to pay out a ton of cash to the documentary makers.

Ever heard of Strife? The 1996 video game doom engine RPG?

The developers who made it got shut down and it floated around in limbo. It became one of the most popular abandonware games for a decade with people illegally downloading it for free

Then in 2014 it was re-released as a saleable product .... except the entire target audience already had the entire game for free.

I'm not denying from a fan perspective it's douchey

But from a legal perspective, a non-biased, cold, impartial legal team is not going to go "Well let's not care about our brand in this instance because we don't think it will matter." they will go "Let's nip this in the bud now incase it does matter later." the moment they hear about it.

And that's their jobs to do that.

I thought they did?? Mario was created by Nintendo as a wholesome and friendly alternative to compete with the edgy and cool nature of Sega's Sonic the Hedgehog. The suits at Nintendo saw how popular Sonic was and decided to make a slower and less cool version for kids who were too intimidated by the fast paced gameplay of a Sonic game, or lacked the necessary platforming skills to play Sonic.

The Mario games were pretty good even if they were derivative from the Sonic franchise. Guess Mario was just never able to catch the limelight like Sonic and was doomed to remain #2 forever stuck in Sonic's shadow.
