It's a shame RBG didn't retire earlier, during the Obama presidency. It's a double-shame the Republicans were able to block Obama's pick, but that Trump got his final-year pick (especially with the fact that people voted against Republicans that year, ultimately).

It's crazy how the SC is just a luck-of-the-draw deal for presidencies. One president can end up creating a large post-presidency legacy with getting to nominate 1/3 of the Supreme Court, and another president may not even get that chance at all.

I don't believe in us voting for justices, but I also don't believe in the idea that the SC should disproportionately represent one period of time of American voting.

Almost need a revolving door that limits presidents to one justice per term, as one justice exits each term (although the matters of death/retirement/removal would have to be worked out). That way, we keep the system of a bench that is separate from the public, and is not subject to massive sways, but also have a system that doesn't randomly reward certain time-frames with more picks.

Edit: The needs and wants of the 2016 - 2020 Americans should not represent 1/3 of our SC. At a certain point-in-time, perhaps the needs and wants of 1980's Americans shouldn't be lording over us at all.

well, no. with consistent rules, that's still two. you can argue whether the first or the third was the one that was stolen, but it's still only one of them.

Reagan got 3 in 8 years
Bush Sr. got 2 in 4 years (one of whom became a liberal)
Clinton got 2 in 8 years
Bush Jr got 2 in 8 years
Obama got 2 in 8 years

Trump got 3 in 4 years because the universe just hates humanity.

Yeah, it's true. We could remove ourself of every MAGA republican right now, but the courts being infected, and much harder to remove, will affect us for a long, long-time. The only cure for this problem is time. Just gotta hold people keep rejecting republicans, election-after-election.

He still stole twice. Stealing two times doesn't have to mean that Dems would have gotten two. But based on the rules at the time that it happened, he stole twice.

I understand what you're saying, that both rules can't be true at the same time, so the Dems should only have gotten one of those picks. I don't disagree with that.

What I'm saying, is that the first time, McConnell blocked Obama's pick for a year by refusing to hold a hearing due to bullshit "precedent" that didn't exist. He then handed it over to Trump. That was a stolen pick.

The new precedent was set. And he again went against that rule that he created, to steal the next pick. So he once again stole a pick. You can't have it both ways.

If there was any integrity, Dems should have had one of those picks. But Mitch still went through the act of stealing twice based on a precedent he first made up, then chose not to follow.
