The root issue here is that Congress is intentionally ineffective, and thus delegates actual "lawmaking" to the alphabet agencies while also claiming its hands are tied because it's a regulatory matter involving those agencies.

I'm just not comfortable subjecting new people to a world that we are actively and knowingly destroying. Like there isn't a single person involved in this case that doesn't know that what they are doing is make the world worse. But they don't care because some asshole's property rights are apparently worth more than making even token attempts to help the world.

In a separate opinion, liberal Justice Elena Kagan took aim at the majority for rewriting a statute that Congress had enacted. She compared the ruling with the court's decision last year to limit the scope of the Clean Air Act as part of efforts to combat climate change.
"The vice in both instances is the same: the court's appointment of itself as the national decision-maker on environmental policy," she said.
