He'd probably just say that he won't fold to democrats trying to stop the republican party, or they have no one to put forth besides Trump in a a "fair and honest" election or whatever BS he can come up with.

I think the most interesting part is that he seems to think that if Trump is convicted, it'll be after he wins. He never says former president or even candidate, just president. -_-

As far as I know there nothing in the Constitution that mention a president can't be indict, it just a gop talking point. Unless you are a democrat, then without evidence you should be thrown in prison. The worry is that a sitting president could just pardon themselves, which isn't mention for or against.

It's a doj policy from the Nixon era.

We should make it illegal to even have such a policy in the first place.

Conservatism consists of exactly one proposition, to wit: There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

Founders gave POTUS the pardon power to serve the interests of justice. POTUS is top dawg. I think most SCOTUSes are gonna say States shouldn't be above POTUS in that regard and if POTUS thinks a pardon serves the national interest then he can encroach on the States power.

Probably apply some similar theory they used to incorporate the bill of rights to the States or something.

The Departmen of Justice's website says this:

No. The Presidents clemency power is conferred by Article II, Section 2, Clause 1 of the Constitution of the United States, which provides: The President . . . shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment. Thus, the Presidents authority to grant clemency is limited to federal offenses and offenses prosecuted by the United States Attorney for the District of Columbia in the name of the United States in the D.C. Superior Court. An offense that violates a state law is not an offense against the United States. A person who wishes to seek a pardon or a commutation of sentence for a state offense should contact the authorities of the state in which the conviction occurred. Such state authorities are typically the Governor or a state board of pardons and/or paroles, if the state government has created such a board.

Presidential pardons are exclusively for federal crimes. Period.

Eh, that route flies pretty hard in the face of federalism. Supremacy Clause only comes into play where there's a conflict between state and federal law, so by all rights using that as justification is tortured because it's not a conflict between sovereigns but a question of scope. This should be especially true for the self-proclaimed originalists.

That said, expecting ideological consistency from folks of that persuasion is a laughable prospect.

So youre saying there is no constitutional basis for this, and the only way it could work is if the DoJ and Supreme Court unilaterally decide to ignore the constitution and do whatever they want?

I mean, its certainly in line with their fascist way of thinking. For the rest of us not living in fascist fantasyland, its not fucking happening.

Pardoning yourself is unprecedented, literally. There's nothing that says you can't do it, and we won't have any case law until someone tries.

IMO this is worth preempting with a constitutional amendment to severely curtail pardon powers.

Something like "the president may not offer pardons to any serving member of the federal government and may not pardon anyone at all during a presidential impeachment trial until after it has concluded."

The Federalist society actually published a paper this week arguing that he is, in fact, ineligible already for President because he engaged in insurrection.

The supreme court would have to make that call, legally, however. I think most people would agree he did, in fact, engage in that alleged conduct.

There is the idea that certain states could refuse to put him on the ballot because, for the same reason, he is constitutionally unable to run again, via the 14th Amendment.

Republicans prevented him from being disqualified. When he got impeached, he could have been disqualified from running now, if he had been convicted or whatever its called. But the Republicans voted against it even with the democrats warning them they would regret it someday

They didn't listen because the GOP is made up of cowards who all are terrified of standing up to Trump. Republicans had a chance to be done with Trump and they pissed it away
