Not with the game in them. Its a stand alone display with shelves of games in them

I literally picked a copy up to scan. First thing on item description is street date.

From the sound of it, they had actual copies out on the floor. Retailers who sell early tend to have the full wrath of Nintendo lawyers decend upon them. I once had a buddy sell me a copy of Pokemon white a day early but told me to not get online til the next day for that very reason.
