Everyone attacking Nintendo must not know that Yuzu is primarily used for pirating Switch games and has been for years. Im all for pirating too and hope Nintendo loses, but I also understand why Nintendo would be upset lol.

Emulators are completely legal, doesn't matter. If they're not using Nintendo's code or supplying the decryption keys, they can give it away or charge and Nintendo doesn't have a leg to stand on.

emulation and romhacking for an extremely long time have worked on the simple concept of not fucking charging for shit you release and especially not paywalling shit like a dumbass

so far it generally works out until people do stupid shit like this. not saying nintendo is right, but god damn yuzu painted a target on their back by ignoring emulator etiquette.

Updating the emulator to better run a dumped and unreleased game more than a week before it gets released and then promoting it is another stupid thing.

It is. I'm all for emulating to run homebrew. But any compatibility with commercial games should be the natural result of accurate emulation, not deliberately promoted.

I think Nintendo might have a solid case since the devs were taking donations through Patreon.

Why would Nintendo go through all this effort now, knowing of Yuzu for years? They have something to work with.

Not surprised in the least. I hope nothing bad happens to Yuzu and they win. But the fact they do take in patreon money...does seem scummy.

Also damn switch is strong af with its sales despite being easily emulated. I don't think ps2 had this problem during its peak

Nintendo is one good Christmas sale from passing the PS2. When Switch is considered pretty much done they'll probably put out the Lite for $99 one Christmas season and blow past the PS2.

Yeah, Sony, Epic, Valve, Apple, and Microsoft never go after legal infractions on their intellectual property or bootlegs...

I'm not here to defend Nintendo, or the laws... but hot damn if someone were so aggressively trying to put out bootleg Sony or Apple hardware and pirated/cracked games I would expect those lawyers to go after them... not because of anything I want or how I think it should be... but because I'm an adult in the real world where intellectual property law is quite serious.

Sorry if you don't like corporations exercising the right to protect their profits and IP... Nintendo aint' the problem, they don't write the laws or hand down the settlements, do they?

Nintendo does it about 100 times more, and theyre also massive hypocrites as they literally downloaded ROMs, put them on an NES Classic, and sold it to people. They dont have a leg to stand on here as Yuzu does not use their code and does not supply the decryption keys.

Whats likely to happen here is Nintendo just keeping the case going until the Yuzu devs run out of money, then Yuzu being forked under another name as its an open source project.

The devs themselves may face something because of their Patreom and promotional stupidity, but none of that should impact Yuzu.

Remember how Sony destroyed George Hotz? Nintendo is like trying to play catch-up on that. Only person that even came close to getting fucked that hard was the GTA6 leaker but he's also guilty of a lot of other shit that has nothing to do with piracy.

I think the biggest thing there is that they don't tell you how to pirate right on their site. There was this sort of understanding everyone had of we all pretend we're just legally archiving our games or playing indie games or whatever and things were pretty chill. But Yuzu just decided to go blantant and tell you how to pirate. Bad move. The Patreon often used promises of being able to play a new game with a supporter only build to generate more revenue.

Contrary to popular belief, whether you're making money or not has absolutely nothing to do with if you're infringing on intellectual property outside of strange situations like CC licenses.

Nintendo reserves all rights so you cannot "get away with it" just because you don't ask for money. Asking for money is only a problem because it increases visibility and paints a target on you, but it's still illegal if it's free. Collecting money on your IP theft also doesn't hurt your chances in court in any way because it's irrelevant. Might impact damages if found liable but won't affect if you're found liable at all.

The only thing that's going to matter in this case is if Nintendo can convince a jury that Yuzu is "Primarily for piracy" which is illegal under the dmca.

Just a rumor.
Kawase Tomohiro worked on the classic iNes emulator, which introduced the iNes header that pretty much every Nes emulator uses today.
He was hired by Nintendo as a programmer and he has been involved in every emulator software Nintendo have used since the first Animal Crossing.
He is used to the iNes header and it is a perfect solution for telling the emulator which mapper to use, so why should he not use it? Why re-invent the wheel?

Nintendo never downloaded any ROMs from the Internet this was debunked ages ago.

It's more that Nintendo gets the blame for something a bunch of other companies likely also did.

Konami, Capcom, etc, also released NES compilations of their own, some were years before the Wii. (does that Castlevania & Contra Collection from 2002 contain iNES headers? I haven't checked)

I don't think it's been debunked, but that there was no concrete proof that Nintendo downloaded roms from the internet. A lot of it was based off from speculation, but from what I've seen Nintendo owns the copyright to the games anyways so it shouldn't really matter where they download it from imo.

incorrect. the clu clu land header is the smoking gun that these roms were not downloaded from the internet.
