The government sues itself all the time. Usually it's state-to-federal or vice-versa, but in this instance it seems the actual issue is one of jurisdiction. The chamber of commerce believes the FTC is stepping on their territory and is asking the courts to determine who actually has the power to make these types of rules.

Its creation was encouraged by President Taft to make communication with business easier so I wouldn't say it was named in bad faith. But I'm sure nowadays they're aware of the confusion and take advantage of it.
