The Wisconsin Supreme Court on Thursday accepted a petition from the Democratic National Committee to hear a lawsuit challenging the Green Partys access to the presidential ballot in November.

Democrats had previously filed a complaint with the Wisconsin Elections Commission (WEC) against the Green Partys candidate for president, Jill Stein, alleging she should not be placed on the states presidential ballot because the Green Party of Wisconsin does not have official state officers who can serve as presidential electors.

The WEC denied the Democrats complaint on a technicality, prompting the party to bring the lawsuit to the Supreme Court.

Earlier this year, the WEC voted to allow the Green Party onto the ballot because it got at least 1% of the vote in a statewide election in 2022.

But the Democrats argue that the party cant nominate presidential electors in Wisconsin and without electors, the party cant be on the ballot. State law requires that presidential electors nominated in October be state officers, which includes members of the Legislature, judges and others. Legislative candidates can also be electors.

The statute states that presidential electors must be candidates for the senate and assembly nominated by each political party at the primary, the state officers of each political party and the holdover state senators of each political party.

The complaint alleges the Green Party doesnt have anyone who qualifies, so it cant be on the ballot.

Because the Wisconsin Green Party has no affiliated individuals who are eligible under Wisconsin law to nominate presidential electors for the Wisconsin Green Party, the Party cannot as a matter of law field a candidate for president for which electors in [each] county may vote, the petition from the DNC states.

Wisconsin Green Party officials have said the organizations coordinating council functions as its state officers, who can serve as electors.

In a dissent against the majority decision to accept the case written by Justice Rebecca Bradley and joined by Chief Justice Annette Ziegler, Bradley objected to the lawsuits accelerated timeline. After accepting the case on Thursday, the Court ordered that the parties involved file responses to the Democrats 5 p.m. on Friday.

To my knowledge, at no time in history has the court issued such orders before parties had made their appearances or retained lawyers, Bradley wrote. While WEC has the Department of Justice for counsel, nothing in the record suggests the Wisconsin Green Party has even retained counsel yet.

Dr. Michael White, chair of the Wisconsin Green Party, said the party is still looking for legal representation.

We do not have counsel, we have not had opportunity to obtain counsel, White told the Wisconsin Examiner. This is an effort to silence dissenting voices in swing states. We will fight to the best of our ability. It is the position of the Wisconsin Green Party that all voices should be heard and all votes should be counted.

The only time I'd consider it shady is if you can prove that she was trying to put herself on all 50 state ballots. If she is solely trying to get onto WI, it suddenly looks pretty suspicious that the only place she's looking to appear is in a major swing state.

As I said, I don't know, and I'm a little too sleep deprived at this point to do research until later. I'm just saying that if she's trying to get onto all 50 states, the Dems trying to DQ her from a swing state is shady. On the flip side, if Stein is only putting in to be on the WI ballot, it's shady in its own right.
