Can't do that. The 14th amendment guarantees citizenship of any individual born in the United States. Sure as well can't overrule an amendment with an executive order.

He promised to send Roe v Wade back to the states and now women are dead. He can actually do some things.

Dismissing it as a loop where nothing actually happens is utterly disingenuous.

You gotta understand though. The Constitution don't mean shit to those people, unless it's the 1st & 2nd Amendment. And then it's only if they can benefit from them, and no one else.

no, he can't rewrite the constitution, and there's no chance you get enough states to agree to an amendment.

Very unlikely the SCOTUS actually stops him from deporting people, though.

Given how the Heritage Foundation unironically wants to do DNA tests and deport people if they have an ounce of Non-American DNA in them, it seems like it'll happen.

We'll see, won't we. Federal employees swear an oath to the Constitution, not the President.

This does make me curious whether there's a way to legally punish people who knowingly and directly violating the US Constitution, though. Like, for example, Trump does this, the SCOTUS says it's legal, and people obey, then rational people win back the government by whatever means you choose to imagine, is there some crime to charge the people who obeyed with?

That would include a lot of white people (such as my little brother and sister, who are both half-Mexican), but we know white people won't be tested.

A Supreme Court ruling on the 14th Amendment guarantees citizenship to any individual born in the United States.

When Trump signs the Executive Order and ICE starts rounding up people for deportation, the legal recourse is to sue the government. That case ends up at the Supreme Court, which can overturn precedent and rule that the 14th Amendment does not, in fact, guarantee them citizenship.

the point is, he won't need to rewrite the constitution, and he won't need to pass an amendment. he will just do whatever the fuck he wants and nobody will stop him. that is the reality of what this administration will be like. that's fascism. that's authoritarianism. this country is not a constitutional democracy anymore.

Ok, need to throw some cold water on this...

I know, full well, we have a reason to be skeptical, but this is a direct part of the 14th amendment and while SCOTUS ruled in favor of a lot of what Trump wanted, they blocked him on a number of things with his own justices being less radical than Thompson and Alito.

LEt's not get too worked up about stuff that hasn't happened yet.

It will be an argument on how the constitution is to be interpreted. Their argument they will put forward falls on the part that says "subject to the jurisdiction of". They will claim that since illegal immigrants aren't subject to the jurisdiction of the United States then neither is the child.

With a stacked scotus all he needs is some sort of an argument like that. I think it's possible but highly unlikely.
