I would suggest stating just a flat figure that you consider fair for you to move, and let him know you can break down the specifics if needed. He could easily just go for a number, but if you break down individual points, he might decide to argue some of them.

oh yeah for sure. that's what he said. i said all that i minimally required. he said find a new place to live, figure out the expenses and then we can discuss a hard final number once i've calculated all my expenses. i'm just breaking it down here for conversation sake.

I would also review your contract/lease as quite often there is a clause for breaking the lease included. This is usually done for the Landlords protection, but would give you a clear starting point (you could ask for more, but would in no way agree to less then that amount).

i have reviewed my lease 100 times because of the nature of my job. that's why that handwritten note was such a huge red flag to me. i knew my lease didn't give him grounds for a 30 day notice at all.

Also, it matters if he actually served you with a 30 day notice already. In most states at least, all the protections are there for the tenants, giving them quite a few ways to break a lease without penalty (unfixed/repaired items, finding another person to rent the unit in your place etc).

he didn't. he thought they did but the secretary at his company confirmed they never mailed me a notice to vacate in 30 days. legally per my lease they need to give me at least 60 days so i would have fought that.

There is no....specific...penalty (well at least in the states I have lived in) for a landlord that serves a 30 day notice that can't be enforced (for whatever reason), but..there is if the landlord actually tried to physically remove you (with the help of police, changing your locks etc). That didn't happen in this case, but it's still good to keep in mind he served you with a 30 day notice. It's his error, and if you do end up in court it could matter.

if he did any of that he would have grounds for a lawsuit against him, which i am prepared for. in my state i can get 3x damages for unlawful eviction and my attorney costs paid. plus since i work for an insurance company i could have found an attorney likely to take me on initially with no out of pocket cost to me at least for a consultation and then i could hire them on contingency. and it's not a conflict of interest because it's not related to my job. they would just do me a favor of not charging up front because they have relationships with a lot of us.

not for me. i have a lease agreement either with him or my current landlord. that'd be a dispute for him and my current landlord lol. either way i have a contract signed that has been legally transferred with the house and if he wants to dispute the sale he'll have to take it up with the property manager and they'll honor my lease and try to sell the house again. my PM has like 100 houses they are trying to liquidate so they can retire.

Even if it is true, he would at least need to legally move into the house and change his address, for a month or two, so it would still be worth at least 2 months rent just to avoid having to do that.

they bought it under an LLC so it'd be hard for him to make the argument he wanted to use it as his primary residence.

well it's the area we live in. i have a 2br/1ba house from 1970 with a big yard for $1200 a month. it's not a great house. but the area is fantastic.

if we move to a different area we could pay the same rent or less for a 3-4br/2-3ba house with a yard etc.

i am going to at the very least not move unless i receive:

my deposit back for this home ($1100)
first month rent in my new place (to be determined but i'm not gonna get greedy obviously, it will be similar to our rent now $1200 which we can afford)
deposit for my new house (around $1200)
a pet deposit for my new house (whatever the charge is)
rental application for a new house
any and ALL moving expenses, which will include movers because of the inconvenience of moving (>=] college hunks move your stuff here we come)
and last month rent if required.

BUT i'm going to start HIGH and see if he wants to negotiate down to those things so i make out with what i want and he gets what he wants.

you have to understand houses in my area can sell for $250,000-300,000 and they're just small 70s single floor houses. simply because of location.

if this guy pays me $7k to move out of a house he probably got for $120k as part of a bulk sale from my current landlord (7 houses) he's still making out like a fucking bandit for his flipping house sales.

he said he didn't realize we had a lease when he bought the house. he thought he was getting a soon to be vacant house.

i told him i'd be willing to discuss breaking the lease and he told me i was "speaking his language"

i have this guy by the balls. if we don't move out we won't leave til Feb 2019, they have to flip the house and then wait to sell it. it could be until 2020 until they could sell it if we don't move.

i told him i'll talk to my boyfriend. he said to do that and find an actual new place to live and we can talk hard numbers.

i'm not moving for less than $5k.

So they guy called after not returning my first message when I left a second message but I was cooking so I missed the call.

He left a message saying he couldn't do the inspection because no one was home (the letter didn't say someone needed to be home and he obviously entered the home ????????) and that he was misinformed about or lease being terminated so he "apologized for that."

I returned his call and left him a message saying the letter didn't say anyone needed to be present so maybe he should be more clear in the future and that we already have begun looking at other units because of his letter and I'm really not happy with the way this relationship is starting out.

So we'll see what he says when he calls me back.

omg my current landlord is pissed.

one of the office managers finally got in and the secretary told them what happened and showed them the note.

she immediately got on the phone with their attorney who basically verified my lease is binding and it'd be illegal to break it. and so she tried to call the guy and he isn't answering.

so she called his company and the company was like "oh that must have been a mistake! he got the wrong house!"

i don't want this jackass to be my landlord anyway. i hope they buy out my lease because i don't want this incompetent company anywhere near me and my living situation.

i went to the office on my lunch break to get a copy of my 2018-2019 lease and they were like why what's wrong

i showed them the note and they took a copy of it

the girl said that the guy agreed to take over all the leases and that they sold the seven homes to him. she was like i hope he isn't trying to do this to everyone.

i talked to an attorney and they said they can't terminate my lease unless they are planning to be the primary occupant of the home if we've already signed a lease for the upcoming year.

i asked if i could use that as leverage for them to pay our moving expenses if they want us out and if we disagree they would need to try to formally evict us and we would produce our lease agreement.

No. I read my leases throughly. There's nothing in them about transfer of ownership in the home. I read through it again last night to verify. I read my leases because I want to know my rights and responsibilities under the contract.

Also @Zangulus I really don't want an eviction on my rental history. That will make it really hard for me to rent in the future and I don't want to buy a home.

Did you sign your new lease before or after the property was sold? If before, unless there's a clause allowing the termination of the lease upon transfer of new ownership, then the new owner must honor the existing lease. If after, then you signed a new lease with the wrong person. Also make sure the old owner returns your security deposit or transfers it to the new owner.

we signed it before? i'm not sure they have not kept us in the loop at all. we signed and mailed the new lease in november.
