Just out of curiosity, does anyone else agree with Corrik that if no one is in immediate danger, but the fleeing suspect might go on to shoot someone an hour from now, the cop would be justified to shoot him?

I feel like even the other people who disagree with me arent down with that, but I could be wrong.

I find this to be exceptionally absurd.

A cop doing his job isnt to kill people. Its an unfortunate consequence of doing the job. No one should ever be killed because of something they might do minutes or hours later. Thats plenty of time to apprehend him.

I can say its justified if they are running towards another person nearby.

But once they turn around, theyre no longer a threat to YOU.

I can also say that if you have visually established that they were armed, and did not see them disarm, its fair to assume theyre still armed, sure. But you definitely have to have that established first.

Like lets say you get pulled over again. Cop sees your record, knows that you were driving erratically. You are in fact over the legal limit, but not obviously so.

Should that ALONE be enough to arrest you for drunk driving?

Cop has to know he has it.

Also theres a difference between morally justifiable and legally justifiable. You may be able to make a moral case for this, but not a legal one if he has no weapon.
