If the service you are using operates in the EU, they'd likely still be subject.Couldn't you just refuse to agree and you would still be able to send images and videos if you and the person you are sending it to are outside the EU, since this wouldn't apply to you? If so, that would explain why DA tightened it's ToS and banned a whole lot of NSFW users last year, besides payment processor bullying.
