Because waiting a few years for the minor to commit the same crime again before administering the sentence that would have protected society is very, very different from waiting a few years to have sex. Charging a criminal as a minor is about protecting society. Preventing somebody from having sex with a minor is about protecting that minor.

Isnt it only protecting the minor in certain cases, though. I just ask because they are usually still having sex with each other. And can still consent to each other at a younger age. I mean, consent laws are just weird anyone. Not to mention, can change somewhat easily...


The fact of the matter is that having sex requires a risk assessment. Maturity helps make that assessment, so when an adult has sex with a minor, there's a power imbalance there, and power imbalances always make a mess of consent issues.
