Gamble vs US will really be the case to watch. It's why Trump wanted Kav in the first place. If that goes as Trump wants to, he can simply pardon all his cronies without Mueller being able to bring state charges against them.

Man I hope you've never broken a law.

I've seen a lot of Americans get pissed because cops stopped them for speeding and its always the same excuse "They should go and deal with bigger problems than me!"

Everyone thinks when they break some law or rule that its an unfair and unjust one. its only unjust because everyone thinks they are special but obviously there's people breaking even minor rules because its just a silly rule...until they want to start preaching, then its important.

Did you read the article about Mueller taking the potential for this into account with what he's charging people with? Like they purposely didn't charge Manafort with certain things so he could be charged at a state level if need be.

This is about immigrants.

It includes people who have immigrated to this country, passed the pee test, etc. And it's about whether or not the federal gov't is allowed to detain them prior to deportation proceedings.

Kavanaugh's stance is that we have a '96 law on the books stating that if they've committed crimes, even minor ones, then they can be held whenever, even if they've long since been released from police custody.

Gorsuch's like naw that's dumb.

The plaintiffs include people who entered the country illegally, tourists or students who overstayed their visas and lawful permanent residents. Among them are immigrants who arrived in the United States legally as infants, committed minor crimes like possessing marijuana and were detained years after completing their sentences.


Basically, are you an immigrant? Did you commit a crime on this here list, some of them minor? Then, the feds can hold you as long as they want, and bring you in whenever they want, even if the cops released you years ago.

The Breyer response was to at least allow them bail hearings if federal authorities were making moves to detain them, because as it stands now, if you're detained, you don't get a bail hearing.

The federal law itself doesn't impose a time limit on the ability of the federal government to arrest these criminals. "When the alien is released" doesn't really denote a set period of time. The language of the law is really lacking so I could see why this is being deliberated.

Breyer floated a compromise, suggesting the government could seize criminal aliens within a reasonable time of their release. Chief Justice John Roberts seemed interested in this possibility, though both Tripp and Wang rejected this alternative.

Justice Brett Kavanaugh was skeptical of Breyers proposal suggesting it amounted to rewriting the law.

That raises a real question for me about whether we should be superimposing a time limit into the statute when Congress, at least as I read it, did not itself do so, Kavanaugh said, noting that Congress understood federal immigration authorities would not immediately seize criminal aliens on their release when the law was adopted.

Kavanaugh heard his first arguments as a Supreme Court justice on Tuesday, sitting for a pair of cases involving sentencing rules.

Immigration authorities often do not learn of a criminal aliens release for long stretches of time Tripp said the government sometimes learns of an aliens release when they are arrested for a separate offense. In that vein, Justice Samuel Alito noted that so-called sanctuary cities can prevent the government from learning of a migrants release by concealing information.

California is not going to tell the federal government, look, were releasing this person and this person is an alien, not a citizen, and this is what the person was convicted of,' Alito said.


The case, Nielsen v. Preap, will be decided by June.

Mueller has already confronted this issue and strategized around it, said Jed Shugerman, Fordham law professor.

The case, Gamble v. U.S., gives the court the opportunity this term to overturn past court precedent that being prosecuted in federal court and again separately in state court for the same actions does not violate the Constitutions ban on double jeopardy.

The case received increased attention after Sen. Orrin Hatch (R-Utah), a key member of the Senate Judiciary Committee that helped usher Kavanaugh to the bench despite sexual misconduct allegations made against him, filed a friend-of-the-court brief urging the justices to nix that rule.

Such a ruling would mean presidential pardons, which only apply to federal crimes, would have the effect of insulating those receiving pardons from state law prosecution as well. That could have been a key issue in the Mueller probe, in which former Trump campaign chairman Paul Manafort, former White House national security adviser Michael Flynn and former Trump attorney Michael Cohen faced a multitude of state and federal offenses. A pardon of any of them would not have saved them from state convictions without a high court ruling reversing the double jeopardy exception.

But prosecutors on Muellers team, likely anticipating the potential change in the law, have been careful to avoid charging for crimes with state law overlap.

For example, Mueller chose not to charge Flynn with federal kidnapping charges for an alleged plot to kidnap Turkish cleric Fethullah Gulen from his Pennsylvania home and return him to Turkey. Now any pardon of Flynn would leave Pennsylvania state prosecutors free to pursue that case, rendering Trumps pardon useless regardless of how the court rules.

Even in future cases where presidents may leverage pardons, federal prosecutors are likely to follow Muellers playbook.

There are so many state crimes that even if the president pardons someone for federal crimes, there is going the be some way for state prosecutors to go after them, said Ilya Shapiro, senior fellow at the Cato Institute, which filed an amicus brief in the case urging the court to overturn the double jeopardy exception.
