No, because they fully intended to execute him and then granted stays requested by Davis. If they wanted to protect him from this "torture" they should have stopped issuing appeals on his behalf.

They granted said reprieves sometimes as late as an hour before it was about to happen, probably often giving the man hope, even when he may have been ready to accept death, only to then go "Nope, we're not looking into it further. Reschedule the execution."

That's torture.

hey subdeity whether or not it's torture has no bearing on the degree of injustice involved here.

in that a man who is of doubtful guilt is being executed

how is the guilt in doubt, you ask? witnesses have recanted their testimony, two of them have implicated another man, and multiple witnesses have reported being coerced into testifying against Davis by the police.

the one bright side to this is that hopefully people will wake up after this and realize how stupid the death penalty is.

This isn't Phoenix Wright or a feel-good episode of Law and Order. Most prosecutors aren't going to cast doubt on their own case, especially one that has become so big. It'd destroy his entire life.

I remember there being a case in Texas where protesters led by Jesse Jackson tried to get a delay and never did, and new evidence came up a week or two too late.

Nothing changed. In fact, they might've just started killing people faster down there.

At this point, I think he's banking on everybody just giving up after, or sufficient proof never coming, even if it does exist. Sadly, give it a month or two and all the attention will die down. Then it's suddenly not as bad to be wrong.

a) the prosecutor would have more reason to come up with shaky reasoning to affirm Davis' guilt than the defense would to doubt it, given that the whole point of this struggle is to put the right man to justice for the crime. If new irreversible evidence was given that Davis is guilty, people would calm down some. Admitting that you put an innocent man to death is far more embarrassing, and I could envision the prosecutor taking any steps possible to save face.

b) the fact that the court of law ruled against Davis doesn't exactly support your argument because we think that the court made a mistake in the first place by continuing to sentence Davis to death. You're essentially saying that the judgment of a court of law is always right and fair, and it doesn't work out that way in practice.

The impression I got from that was "we can do it at any point in the next week, so we'll do it out of the blue so there won't be a huge hoarde of protesters and media swarming around"

I might be wrong and off on the details (do dates and times have to be declared well in advance?), but saying they could execute him at any point in the next 7 days sounds odd.
