Simply do what Sega, Xband, and Galoob did, and make cartridges that plugs into other cartridges (even though Nintendo tried to sue Galoob for the Game Genie, yet licensed Xband, even though both devices made temporary ROM hacks to the game data).

Nintendo didn't want them to because it could potentially damage the console and/or cartridges. Also I believe they made changes to the way they produced N64s at one point, and S&S would not work properly on those systems anyway. I may be mistaken on that last point though.

Not when you use the level select thing for Sonic 3 by abusing the system RAM when hot swapping in Sonic 2 twice

The original N64 design stored the data in 10 seconds after you removed the cartridge, while the redesigned model cleaned the memory instantly, so only people with an older console would be able to do it.
That said, nothing really prevented them from saving and loading the data from a memory card...

Foppe got it.

The original mechanism was for the data to be stored in the N64's RAM so that it would be held over while swapping out the cartridges, but changes in how the N64 handled RAM storage/data meant that the newer models wiped data too quickly for anyone to swap the cartridges in, so the whole thing was abandoned.

Also, it's "Stop 'n Swop". Spell it right, dammit!
