Basically what happened is the gas station they work at is missing thirty-eight hundred dollars. At first we both thought there is no way someone stole that from a register without cracking the safe.

But apparently, he found out today, that it was over a series of weeks that this all added up. She has admitted to taking twenty dollars from the register one time but said that was it. A recent employee was tranfered to another store because she blew the whistle that she was stealing from the register. So the evidence is pointing in her direction.

My question is, if she is convicted of this crime. How long would she go to jail for? Oh and this is her first offense too.

If it's under $5k, I don't think it's necessarily a felony, so she may go to jail briefly instead of prison. It varies depending on where she is though. I'd be amazed if she went to prison for that. She'd probably just have to pay it back, be put on probation for a few years, and do community service or something. It's hard to say without more information.

Might depend on how much money she can pay back. Otherwise that's going to vary region to region, but women only serve 66% of the same sentence that a man gets and they're 33% less likely to be convicted, iirc, so she should be thankful that the justice system has massive gender preferences (plus, if she does go to jail, women's prisons are generally safer)

I actually don't know her at all. He told me everything up to his knowledge, though. But he has only been with her for like 3 months and he has only known her got like six months.

odd not according to my mother who has worked both men and women's prison, maybe my memory is fuzzy though i'll ask her next time I speak to her, especially since shes working at a prison now where in under half a year there i've already heard about several stabbings, even on guards. they even found a hit list on the guards, and the higher ups actually tell the guards to do what they must to make it out alive at the end of the day.(shes at a men's prison now)

i'm thinking beforehand she got lucky and got not so rough prisons.

They need some evidence, even over another employee "blowing the whistle", to convict her of anything. They could look at her bank statements etc, and of course any video that was available, but they can't even arrest her without some form of real evidence (and he said/she said doesn't count).

If she admitted to stealing 20$ they could possibly arrest her for that though, and use it as a justification to search her bank accounts etc for more evidence. If she didn't do it though, and there is no other evidence, she should be fine.

If she did do it...then it's likely she wasn't smart enough to hide the money and spent some of it, and that can usually be discovered.

If she is really innocent though she "should" be ok. That is saying that nothing corrupt goes on, nobody is actively trying to frame her etc.

Stealing any amount of money from an employer is monumentally stupid. If it was really just $20 she took than hopefully nothing too severe happens to her aside from the fact that she should be fired. If she does end up taking the fall for the larger amount she is at least partly to blame.
