A cops job, as part of the executive branch, is to enforce laws, not choose which ones to enforce. If he wants to challenge it, he should do it as a private citizen, not while hes on the job.

There is a difference between a judgement call and this. For example, a cop pulls you over for speeding and decides to let you off with a warning is not the same as a cop flat out saying you know what, I think people should be able to steal cars so Ill never arrest people for or bother with car theft situations.

As someone else said, as a private citizen he has every right to fight against stuff like this on his own time. Hes not the one who gets to decide what is just or not.

This. It's legal in my state, but even before it was, cops showed up at my buddy's apartment while we were smoking. In fact he had just taken a bong rip and was still holding the bong when he answered the door. He thought his ex-roommate was knocking (to pick up stuff he hadn't taken yet after moving) but he was very wrong. As it turned out, the cops were looking said ex-roommate. They didn't care that we were smoking and even made a joke about my buddy's reaction when he opened the door.
