Long story short, the FTC wants money (hence the $170 million fine against Youtube as well as threatening to SUE Youtubers who don't classify their videos correctly with a $42,000 fine. I am NOT exaggerating when I say they will sue people for that money. In this video below, one of the main FTC guys within the first minute of the video below says he will SUE anyone... this includes casual Youtube users who have gameplay clips of something like Super Mario Odyssey and Crash 3 on their Youtube channels and don't classify them as "for kids".

The video also shows what the FTC considers "for kids" and given the way the law is written, ALL video games technically fall under "for kids only" given their legal definitions (the way it's written even something like Grand Theft Auto can fall under what the FTC considers "for kids only". The video below goes over this and even shows off the legal laws the FTC has in place regarding this). On a side note, some people are asking WHY the FTC is doing this now and not before given how Youtube has been in existence since 2006 or so. The president appointed brand new people to the FTC last year. The FTC wants lots of money (hence the reason why the fines are an expensive $42,000 per video in violation). I'll leave it up to you to draw your own conclusions:

(it should be noted that a very large percentage of content on Youtube might be no longer available once 2020 starts, especially a good amount of gaming content and whatever else you might watch).

https://www.youtube.com/watch?v=0veLrwd9CK4

This news article below goes over all the new people appointed to high positions in the FTC last year:

https://www.reuters.com/article/us-usa-ftc-congress/senate-confirms-first-trump-picks-for-federal-trade-commission-idUSKBN1HX3HZ

This shows all the people in charge of the FTC right now (almost all of them gained their new positions during May 2018):

https://www.ftc.gov/about-ftc/commissioners

If you have videos of ANY kind on Youtube (even casual game clips or something you uploaded for your own amusement) you might want to be very careful on how you classify them since one mistake can lead to being sued by the FTC for $42,000). Also, if there are any videos you enjoy watching on Youtube, you might not want to get too attached to them.

What the fuck is wrong with the FTC

They want money. Trump appointed a shit load of new people in charge of the FTC. They want money. It's not a question of "if" they will fine people $42,000, it's "WHO are they going to fine $42,000?". They want money and their threats of suing aren't really threats, they are promises. People are going to get fined and considering something like South Park (which isn't for kids) is considered a kids thing by the FTC, there are going to be a lot of innocent people getting sued because they classified their video as "not for kids" and the FTC decides to disagree based upon their own written laws.

He's NOT defending them, he's asking what the fuck is wrong with them because the FTC are acting like a bunch of assholes. What the fuck is wrong with them? My personal theories:

1) The assholes are on drugs causing them to do fucked up decisions while in power.

2) The assholes have never gotten laid and are now taking out their frustrations on others by wanting to fine them $42,000 per video.

3) Trump wants these assholes to get LOTS of money by any means necessary, which is the reason Trump appointed them.

4) All of the above.

Ok, so I do let's plays.
We are too small to monetize anyway, but!

According to FTC, since we are playing Luigi's mansion 3, I have to classify it as for kids, while YouTube would say otherwise because of things we may talk about, or swear.
So I suppose it's safer to go with FTC, since YouTube at least won't sue us.

Net Neutrality was FCC, this new issue is made by the FTC.

Both are very similar situations though, with seemingly greedy people trying to control the internet.

Nope. You're not safe even doing that. FTC still checks your videos and still issue the fine if they think the content is for kids and you labeled it "not for kids." They're out for blood.

I think it's already passed, because they said it'll take effect at the beginning of next year.

Hopefully with enough backlash they'll reconsider because this is a violation of several amendment rights.

Sure, the FTC pushed this out, but I have a feeling Youtube's partially to blame for this starting anyway, given the blatant double-standards they've displayed concerning their own rules and regulations.

Realized you mentioned the other option. Still, from my understanding, the statement that no matter what you label it you're under scrutiny still stands. They'll still look at videos labeled as "for kids" and deem if it's a correct labeling or not.

Plus it's just not an attractive option in general because it's not gonna be shown to people. It does more than just cut revenue, it prevents it being advertised and showing up on recommended lists. People make videos so that others can see them, so what's the point if nobody's gonna see them?
