While I agree about not prosecuting with the limited information I have, I would strongly recommend the victim to sue the kid in a civil trial. The kid's family has to pay for the victim's medical bills and unemployment at the very least.

He is a special ed kid. The parents had nothing to do with his problem, neither did violent video games. He has a mental illness that causes him to lash out. He needs help, not prison or lawsuits.

It doesn't matter if the parents aren't at fault, they're still liable for compensation. The teacher doesn't have to pay.

I would first try to retreat and avoid confrontation. If that's impossible, then I would use force. It really depends on the environment and the circumstances of the attack. If I'm the only one in danger, retreating might be my best option. If other people might be in danger, especially kids, then I would definitely use force. Considering the kid isn't tall enough to hit me on the head, I wouldn't mind taking a blow while I forcefully attempt to grab their arm and disarm them. Once the weapon is out of reach, I would only need to grapple the kid and force them to calm down before I let them go.

Yeah this. Chances are she didn't want to use any kind of force that would be considered child abuse.

Reminds me of preschool daycare. It was in Charlotte or Pineville NC or something called La Petite Academy in the mid 80s. It was around pickup time and some kid named Justin came from behind and started karate chopping me when I was playing Number Crunchers on the computer. I was so stunned I just stood still and let him hit me in shock. I remember the black lady attendant teacher yelling at me wiping my bloody head in the bathroom, "Why you just stood there and let that boy hit you like that?" Shit used to play in my head for years whenever if I"d get in a fight.

Twist, the boy and I ended up being friends then rivals(in his mind) and got in a fist fight later in 7th grade in the library after he lost to me in an arm wrestling contest and felt embarrassed. This was 2 years after sleeping over at his house and his Dad and Stepmom treating me well. Their dog bit me, still have the scar.

I never knew what was wrong with that dude, but he turned on me one day. He ended up being a stoner in high school. Last I heard he was a construction worker in Boston from FB. *shrug*

I was always friendly with the dude. Think he had some aggression trigger. There was always one or two people every year that didn't like me no matter how nice and friendly I was. Never did figure it out. My gramps had this saying when I'd mention it, "There's always one more son of a bitch than you counted on."

I used to let that shit bother me for years and years. I'd sit introspectively thinking on why the few outliers we're mean to me when everyone else liked and defended me. I had a psych in college on Fridays that just flippantly said, "It's common. Don't give them any more of your time than you have to and avoid them." It blew my mind when he said that because it was so simple yet all that time I had been looking for some key to fix them and get along with them.

Oh well... memories are crapping me out. Thought I'd share.

That would be idiotic on her part if that was the case. No, I believe she was taken by surprise and stunned.

Sad part is, if the teacher defended themself, they would have been seen as the bad guy.

All I remember is not feeling it even though I must have. I remember that lady lecturing me and my Dad lecturing me too. For a a few weeks my brothers (who didn't live with me) and my grandpa was giving me the typical how to deal with bully speeches in their own individual ways.

Oddly enough, I don't remember Justin being at La Petite after that. I remember that older kid Andrew or something and another rattail kid who always started shit with me, but I don't remember Justin until they moved into Raintree.

Him and his friend Kyle came over and hit golf balls down this long straight patch into the golf course. We had the perfect house for it.

I remember thinking it was my fault. Shit was always my fault as a kid. But how I bled? I remember it wasn't my nose, it was the area just below my temple. And my ears? I remember my Mom saying I got my ears boxed in and laughing about it later. I remember the scab and the raw skin. I remember being teased about it too. Kids are assholes. I was always a nice boy.

Also, it's not hard to evade an attacking 5 year old. Even if they sneak attack you lol

We really need to go back to the days where people can smack kids without becoming a monster (obviously there's plenty of situations where that wouldn't be acceptable still but that's why context matters more than the action itself)
