There's no ill will between him and the woman he was with, but they don't have a desire to get together either. They are not married, not common law, nothing.

She expressed a desire to keep the pregnancy since she's in a stable position in her life with a good job, a house, and wanted a child someday anyway.

What rights does my friend have? He has no reason to think she would deprive him of being able to see his hypothetical child, but all the same he might take comfort in knowing he would still be legally entitled to at least some parental rights.

Differs slightly state to state but if he wants to be a father, he will have to go to court most likely. While if they were married or actually dating he'd be presumed the father, they're not. In most states fathers have no rights in his situation until paternity is established. Don't let him be a dumbass about this. NO "trust" her, "work it out" or verbally agree on jack shit. It all needs to be handled in court as soon as that kid's blood can be tested.

Yeah my friend wants to ideally work out a co-parent situation where they split custody of the kid.

Are those rights just a thing that kicks in automatically?

This is weird logic. Having a kid is a much bigger choice than that or should be. This is why we cant have nice things.

Not knocking her but it seems really utilitarian of Well this works out well on my spreadsheet instead of actually wanting a child.

I say this mostly cause in this situation it was a fluke happenstance and just going O well, lets do this is weird to me.

Yeah like my friend has known this person for like a decade prior to them hooking up, but he figures she wouldn't be opposed to going through the legal system on this, so while that's more money spent on paperwork and lawyers than he'd like it hopefully won't be an ugly legal knife fight.

yeah it feels oddly informal but my friend felt like he wanted a child in the next few years anyway and if one partner wants it then there's no reason to fight it I guess?

maybe that's a sign they'll be shitty parents, but sometimes life happens and you roll with the good with the bad I suppose

she doesn't have to agree to any of this, she can be served with papers and should be formally regardless of what "your friend" and her verbally agree to. if "your friend" wants a free consultation with a real lawyer who specializes in family/custody law you can PM me and i can put them in touch with someone for a free consultation.

He needs them established by a court. If she decides later on to move away from him and not let him see the kid hes got nothing without something set up by the court.

Sounds like a business transaction. He needs to get his rights and baseline limits worked out, and get it all documented. Then you can work on verbally agreeing to stuff if everyone is reasonable

What if the lady gets brain damage from a stroke or some sort of mental instability and can't be reasoned with? Ho boy, have fun with that fight

Sometimes it's better for everyone involved, (including the child) to not try and force a loveless marriage together.

Anyway, your friend should definitely consult with both her and a lawyer immediately. See if they can get their name on the birth certificate and then try to work something out from there.

My friend actually has a family friend who specializes in this field so he'll try to meet with them this coming week. He might still take you up on that but he'll let ya know.

Ideally it should force commitment from both ends to have your friend help his baby mama secure an optimal environment for the kid to be raised in. An absent father skyrockets the chance of a lot of behavioral problems that could make life a metric ton more difficult for the kid years down the road that could be outright avoided with the kid's father directly raising the kid.

Problem is most people don't understand what marriage is about nor value it so it doesn't impose the heavy pressure to commit with society helping to enforce this with social pressure. But opting for shared custody in different homes doesn't have the same effect as marriage because decisions can change at any time. One of them could get a new job and relocate to a new state, thus cutting the kid off from the other parent.
