A Los Angeles judge says she will dismiss a child sex abuse lawsuit brought by the stars of the 1968 film Romeo and Juliet.
Olivia Hussey and Leonard Whiting alleged the film's director coerced them into filming nude while underage.

A Superior Court judge found the scene wasn't "sufficiently sexually suggestive" to overrule First Amendment protections.
Hussey was 15 at the time of filming and Whiting 16.

In a tentative ruling issued on Thursday, Los Angeles Superior Court Judge Alison Mackenzie said the plaintiffs "cherry picked" which statutes applied to their case. She also said the lawsuit did not meet the requirements for suspending the statute of limitations for child sexual abuse.

Attorney Solomon Gresen, who represented both Ms Hussey and Mr Whiting in the case, told BBC News he felt the ruling was on "the wrong side of this issue."

"There's no First Amendment protection of nude children simulating sexual congress," Mr Gresen said.
He said his clients are considering an appeal and he intends to file a separate lawsuit in federal court.

In a joint statement, Ms Hussey and Mr Whiting, now both in their 70s, said they would continue to fight.
"We waited going on 55 years for justice. I guess we'll have to wait longer," they said.

Its hard to argue that nudity isnt sexually suggestive when the purpose of the nudity in the scene was to suggest sex between them.

That film is rated PG in the UK.

I saw it at school with no permission needed. Teachers were allowed to show films that the class were old enough to see in the cinema.

Wha..... In data analysis cherry picking is looking at the data that makes your case while ignoring the data that contradicts you. Here wouldn't that mean using the laws that applied to their case and ignoring the laws that didn't? Isn't that how all court cases work?

I remember being in school and the music teacher was showing us clips from both the 1968 and 1996 movies.

A lot of fast forwarding past the nudity for the 1968 one was required and even then that wasn't good enough.

No it would mean picking laws/precedent that works in favour of your case while ignoring stuff that actively works against it. Like claiming that free speech is unlimited because it says free speech in the constitution while also ignoring that it is very much law that you can't yell "fire" in a crowded theatre.

My teacher didnt try to block it or anything, but told the class "there's gonna be a nude scene coming up and I expect you all to act very mature about it."

Ok I watched the scene and its fucking awful and they absolutely should have won. It was absolutely not okay.

Side note just found out this movie was way back in 1968. Did this movie pave the way for the 70s era of pedophilia? There were a whole bunch of movies like that, and I think stuff like underage or even 16 year old girls in porn. There was also this actress who was like consistently cast nude when she was like 13. Not sure if the same girl who was on the lame island movie of the shipwrecked kids.

Just feels like this movie started it all now that I know it exists

There's a rape scene in Last Tango in Paris that wasn't in the script. They told the actress it was happening the day of shooting, and said she was left feeling sexually humiliated.

The director later said it was done to get a genuine reaction out of her, and when accused that her stole her innocence, he said "she wasn't mature enough to understand what was going on anyway."

Lol funny story about this one, the teacher knew where the scene was and attempted to fast forward. The shitty VCRs in those days didn't really respond all too well, so the moment she pressed fast forward, the scene froze for a good 3 seconds before actually fast forwarding, and us boys deep in the puberty phase got to see some boobs
