They want to give the temp speaker full authority but McHenry said that not only does he think that it's unconstitutional to do, but that he'd resign if they tried. So now they are going to roll the dice and hope the next person on the list is more corrupt.

Yes McCarthy had to create a list of temporary speakers.

Apparently that list is "secret" in the sense that only McHenry was revealed.

Under House rules, McCarthy was required to provide the House clerk in January a then-secret list of members that temporarily serve as Speaker of the House if the office became vacant. McHenry, a nine-term North Carolina Republican, was revealed to be the first name on McCarthy's list.

  1. It's some ultra MAGA guy that they want. Maybe even Jim Jordan.
  2. McCarthy put Democrats on the list to appear bipartisan knowing that it would have been next to impossible for the scenario about to play out would happen, and some Republicans want to embarrass McCarthy.

I was asking about that earlier (if we would just move from getting stuck on a speaker vote loop to stuck on a vacate vote loop), and someone said they thought the rule allowing 1 person to call for vacate required the 1 person to be from the same party as the speaker. Haven't had a chance to verify that yet.

I'm not a House procedures expert, but I believe that part of McCarthy's agreement with his caucus was to implement a much lower threshold for calling a vote to vacate in order to get in power. As long as Jeffries gets in without such a concession, individual reps wouldn't be able to do that.

I still don't buy that Jeffries would get enough GOP votes, though.

Until 2019 it was 1 person of either party. Democrats changed it to require something limited to the caucus iirc. The Republicans changed it back to anyone.

So technically the Democrats could have forced the same vote, but naturally it's a stupid thing to do since normally people would just vote on party lines.

The threshold for bringing a motion to vacate stayed at just a single member of Congress until 2019 when Democrats took the majority. That year, the House modified the rules to allow a vacancy resolution to be brought only if offered by direction of a party caucus or conference" a much higher bar.
The new rules package, passed Monday night by the House, changes the procedure for a motion to vacate back to how it had existed before, giving any member the power to raise it.

No because you can vote to delay the motion to vacate and then change the house rules. It requires Republicans actually being on board with Jeffries though.
