To be fair, that happens in every case.

And to be more fair, the reasoning usually has some sort of semblance of a coherent argument or rationality. Even trying to accuse the judge of being biased against Trump is more logical than "there's no evidence the business records are false even though the jury has been presented everything and we didn't spend any time trying to explain how the business records are false cause all we did was attack the witnesses and cry about Cohen talking about us on social media".

It basically feels like they're going "the prosecution may have done their job well, however let's throw out the case just cause" as a reason for dismissal, which I imagine is insulting to a judge who takes order in their court seriously and has had his attorneys stall and delay with every tactic imaginable during this time. Judges can get sick of lawyer shenanigans and hold them in contempt.

I hope the judge decides to do something about this at conviction. The trial is almost over and its getting way too annoying to see Trump go unpunished for this.

Yes. That's the sidebar I talked about in Post #26. Prosecution had CSPAN footage that showed Trump was with Schiller 5 minutes before Cohen made the call to Schiller where he said he spoke to both Schiller and Trump.

Defense tried very hard to keep it out, but eventually caved when it was clear that it was going to come in and the only question was whether they let it in now or have the CSPAN witness from a few weeks ago brought back to the stand (and the DA told the judge they had a flight arranged for him and could have him back tomorrow morning.)

So, yes, the prosecution had that and they already entered it into evidence and brought it before the jury.

i'm not doubting this, but do we have any source that cooberates that the jury was shown this at trial?

i mean this is pretty big, to put the argument about cohen lying on the stand to bed and all, but it seems like it must have been overshadowed by sideshow bob's circus show today and i must have missed this.

I've been watching the NYT's live updates for most of the afternoon and they reported it out there - unfortunately it seems that eventually they start removing those updates so it's no longer on that page - though seemingly the last one left is one that indirectly addresses it by mentioning how Blanche was forced to deal with it in re-cross. They mention it again in this article:

The importance of that argument over Mr. Cohen's testimony, which bears on his general credibility, seems clear to Mr. Blanche, who mentioned it at least twice Monday. The photo -- and the jury's interpretation of it -- could become significant.

Iirc it got reduced by 10kish so the bond company could afford it.

Prosecution withdrew their objections on the condition that the $175m bond was put in an account solely under Knight Insurance (rather than joint control between Knight Insurance and Trump as they originally proposed) and was held in mostly cash - Trump's side agreed to these terms so the bond has been accepted.

That whole saga is on pause now until the appeals court hears it. I don't know if that has a set date but IIRC that whole business when they lowered the bail amount from the full judgment amount to $175m carried the condition that it must be held soon-ish. I want to say in the Fall.

If the juror is misbehaving or fails to follow the rules of the court (i.e. they looked up outside info after specifically being told not to) a juror can be expelled and replaced with an alternate juror.

Sounds quite likely with a Trumper but we will see.

I hope the defense continues to bring witnesses like this. They already lost credibility with the judge at the beginning of the trial. More bad decisions cant hurt, right?

If you're a defense attorney, you have to motion for dismissal when the prosecution rests. You gotta motion to set aside the verdict if you lose. You gotta appeal with whatever will stick. You just have to.

If your client can afford it, that is.

It may be hurting them with the judge, but he sent the jury out of the room before he gave most of the smackdown.

Granted, they can probably piece together that given most of his testimony is being successfully objected to and that he's been ignoring/talking over the judge at times that they got sent out and had their time wasted because of that witness's behavior.

Does anyone know of a site/channel/whatever doing non-clickbait analysis of the Trump trial? Getting tired of literally everything on media outlets being about Cohen when, honestly, I don't think he's that important to the case itself.

Honestly left wing coverage of the trial has been a little dismal.

trial coverage itself is generally dismal. all online sources, no matter their underlying integrity, rely on clicks to stay in business. and the last 4 trial days have been about cohen, and cohen generates clicks, so i'm afraid there's no way around it at the moment

Yeah, that's why I've been just posting stuff from reporters on Twitter who are actually in the courtrooms reporting. Until we get to the televised trial in Georgia, that's about the best we're gonna get.

Speaking of Georgia, both judge Scott McAfee and Fani Willis are up for reelection. I have no idea how it works if someone handling a case doesn't get reelected, but we'll see how the results go. Primary voting starts today in Georgia.
