He is vastly more able than past VPs (or anyone else in the current administration) to articulate a legal position, and nothing he said there is per se wrong.

But to answer his question, yes, we want more process to minimize the possibility of error. If the tradeoff is fewer people get deported, so be it. And also to minimize the possibility of falling down the slippery slope - that's important!

And yeah, I see no problem with his idea of having jury trials for everyone. The government's position is that illegal immigrants who have committed no other crime besides entering the country illegally are still criminals because the entry was a crime, right? Well then, seems like they've been accused of a crime and ought to get a jury trial on that.

We barely pay our juries so it wouldn't even be that expensive.

That's not what he said. He agreed that due process is always required and asked, what process is due? He's correct that the law requires different levels of process for different things - for example, a murder case gets more process than a traffic ticket. Now, I would think deportation to a prison in a country not your own would get a very high level of process. He doesn't seem to think so though.

In a free and democratic society law is discussed by everyone. We shouldn't have an class of elites who are the only ones who can discuss law.

If he's made factual claims - and his legal analysis depends on the truth of those facts - then that brings this into the realm of factfinding. That's better than the alternative world where facts don't matter.

Due process refers to the legal process that is due a person before their rights are taken away. For alleged crimes, yes, it includes the right to know what you are accused of and the opportunity to contest that in court. Where did I disagree with that? Please do not insult me.

It's better than the stuff the rest of this administration puts out. That's either complete nonsense, pure political statements, or hypertechnical bad faith constructions of language like this whole debacle about what the word "facilitate" means.

Stating facts (true or false) always invites factfinding. The jury (or the judge) is the factfinder, not the government. Or, in the court of public opinion, the public is the factfinder.

If the government made this argument in court, we could probably get to a clean, decisive, ruling from SCOTUS on the matter rather quickly. It would almost certainly not be in the government's favor. So they won't do it, and will instead obfuscate and delay as long as they can.

So to be fair, this isn't exactly a new idea. This is from 2016:

But the "other" basket the other basket and I know because I look at this crowd I see friends from all over America here: I see friends from Florida and Georgia and South Carolina and Texas and as well as, you know, New York and California but that "other" basket of people are people who feel the government has let them down, the economy has let them down, nobody cares about them, nobody worries about what happens to their lives and their futures; and they're just desperate for change. It doesn't really even matter where it comes from. They don't buy everything he says, but he seems to hold out some hope that their lives will be different. They won't wake up and see their jobs disappear, lose a kid to heroin, feel like they're in a dead-end. Those are people we have to understand and empathize with as well.
