Tough break for Raymond Cruz -- the actor who brought fan-fav villain Tuco Salamanca to life -- 'cause cops hauled him in this morning on suspicion of misdemeanor battery.

Law enforcement sources tell TMZ ... someone called the police claiming Cruz assaulted their daughter -- allegedly blasting her with a garden hose.

A source familiar with the case tells TMZ ... Cruz was washing his car and asked the girl to move out of the way. When she didn't, she allegedly got sprayed and believed he did it on purpose.

The incident went down outside Cruz's home in the Silverlake area of Los Angeles.

Hes now behind bars, and getting processed.

Since it's a misdemeanor arrest, the case would be handled by the L.A. City Attorney. So far, no charges have been filed. With minor infractions, the City Attorney often defers prosecution and holds an office hearing, where the alleged offender is warned and sometimes agrees to anger management courses in exchange for dropping the charges.

I don't know the circumstances here... if there is some history between him and the girl/her family then yea I get it... but if there is no history I don't really see how you get arrested for this.

So, it seems like she didn't get out of the way, he continued spraying (because she wouldn't move and he wasn't going to stop what he was doing), and because she didn't move, she got sprayed by the water that he was spraying?

I wonder if there is more to this story, and of course if there is, I will gladly take back what I said, but right now it seems kind of silly. It's akin to getting in the way of someone washing the dishes and then getting upset when you get splashed with water.

Battery is basically any unwanted physical contact. So yea, it can definitely apply it's just a major question of what the circumstances are that justify charging over something on the surface so minor.

Honestly this is such a non issue. Couldn't they have just ticketed him for disorderly conduct or some shit?

Reading the story as-is is ridiculous. I can allow the parents to get pissy and call the cops, but in no way should they have arrested him. That should have been a knock on the door if he wasn't still outside and like "Come on man, we get it, it sucks, but try and keep it cool a little. Have a good day." and that should have been the end of it.

I really am curious as to what happens here.

On one hand, it seems excessive for the cops to make an arrest based on what has been reported, and if the car was in his driveway and she was standing close to it, it's even possible that she was trespassing onto his property (if you're on someone's property and you don't leave after being told to do so, I believe that is trespassing...), so I'm wondering if there's more to this story that they would actually arrest him.

On the other hand, if it turns out they *did* in fact commit a huge blunder, then, well, lmfao on them. They fucked up.
