"Loser pays" is common in some countries, but not in the US. I think only a couple states have it. It would be a super good reform though to eliminate a whole lot of frivolous lawsuits.

They have to pay for attorneys fees and court fees. They were defending against Amann, not prosecuting him. They basically fought to not lose the case and money. Were they to settle then, it's likely they would have lost less money because these expenses would not have been drawn out by the giant corporation. That's why most times when it's a big company suing a little man, they settle. Because they will just string along the case until they are forced to settle as a result of dwindling finances.

Also, this is probably the idea of Colt's lawyer. I read the action and... Yeah. The lawyer only represented Colt on the pretenses that Punk was paying, as documented via text and various other conversation. I actually listened to the Colt podcast where he said he was retiring after this case. Turns out he has one more case because Punk won't give him his fucking money.

This guy is going to win, likely, and Punk will probably lose even more. Not sure what he expected here. It will most likely settle though.

That said, afaik Punk and Cabana are no longer really friends or something because of Cabana going to a WWE show, which Punk thought damaged their defence somehow.

So I guess when the lawsuit was first made, Punk was fine with paying it and covering Cabana, and now they aren't friends anymore and Punk has decided Cabana is "on his own".

(That isn't a defence - Punk has been a douche on like three different occasions in those two sentences alone. It's an explanation)

"I promised not to punch the guy but then punched him because he looked at me funny" is an excuse

This is why the "CM Punk" chants always kinda bother me. Yeah, he's a good wrestler, but he's never gonna come back for the fans. If he came back, it's not gonna be for the fans, or because he cares about putting on a good match, or anything like that. If he comes back, it's going to be because of some personal reason, whether he needs money or does it to piss somebody off or whatever, and then he'll split just as soon as he gets what he wants.

It's an explanation if he genuinely believes said falling out is the reason he no longer feels any obligation to Colt, or that Colt actively sabotaged them by going backstage to Raw, and so because of those two things he shouldn't have to pay the fees

He's in the wrong whichever, since it's obviously a dick move to renege on the previous agreement to pay as well as throwing away such an old friendship over it.

I was more explaining Punk's mindset, not his possible defence in court. Even for Punk, just randomly saying "nah" to Colt would be insane, I think. But if they were no longer on good terms way prior to the end of the Amann trial, then it at least makes a little more sense why he wouldn't pony up. It wasn't just random heartless c***ery.
