Emily Mackinnon from Canada says her Tinder Match tried to SUE her because she WOULDN'T have SEX with him insisting it was a BREACH of their "verbal contract"!!

She shared the outrageous story in a series of videos with the papers alleging he also sent a cease and desist letter after she bad mouthed him on her new podcast "Been There Bestie"

She said "So we matched on Tinder. He was a law student at the time. We went back to his place. It was implied that we were gonna hook u, but i never explicity stated that."

She said she bailed on her date whom she only named as "Chad" who started taking off his lothes when she was hit with a massive stench of BODY ODOUR and FECES and said "i stood up and i still smelled it, okay. there was like skid marks in his undies, and he had not washed in a long time and he needed some new Fruit of the Looms"

But he didn't take the rejection well and went after her legally and she said "I left and a few days later, he had pad someone ot serve me with papers like to sue me for breaking a verbal contract. But it's okay, i fixed it because he had spent a bunch of time tellin gme about how his dad's a lawyer, so i made an appointment with his dad and just like told on him to his dad. And now he's a real lawyer employed by his dad. And to chad, the man who tried to sue me, i know you watch every single thing that i do. We met one time. You're musty. That's really lame. You need to move it along buddy. And buy some new deodorant if you had any at all"

She says "We get to the stage where he is removing his undergarments and when i tell you it was a sight, it was a f***ing sight. There was trials. There was a vague smell. i had to get the f*** out. I had to evacuate. abort mission"

But years later he went after her AGAIN and she went after his poor hygeine yet again but never said his name. She played the clip and couldn't resist laughing at the audio

After less than 12 hours of that post of her mocking him, she got served yet again by him on a cease and desist letter and she talked to a lawyer who told her it's not slander since she didn't name and shame him.

Other tiktokers were stunned on the unbelievable story..especially on the agreement of sex with Tinder as others said that is not an agreement when using the app.

She called his law firm who say he should not have used the logo of their firm as this was a personal matter on his own...

Emily will update on the lawsuit when and if it goes to a judge or if it gets tossed out..

Do you think Tinder is an agreement to Sex?

It's kind of implied that that's the end goal for all involved parties, but that's largely irrelevant, given that sexual consent is not in any way a binding contract. Consent can be withdrawn at any time and for any reason, at which point everyone else involved needs to accept that the non-consenting person doesn't want to have sex anymore and act accordingly.

It probably wouldn't be slander even if she did name him, given that it was true. Proving its truth would be difficult, however, so it's probably best not to test those limits.

It looks like he's actually suing her for slander, but if she never used his full name then that shouldn't hold up. I don't believe you can really sue someone for publicly saying you had shitty underwear anyway unless it's like targeted harassment

Doubtful not a normal thing people do.

Considering she's ugly and overweight, she might have done him a favor by not hooking up with him. Instead of giving her a lawsuit, he should send a basket of fruit... or some other healthy snack to help her lose weight. Either way, both of them sound like they're kinda lousy people.

Tinder is a special case where yes would apply as they are used primarily for one night stands, affairs, and the like. If this was eHarmony where it's designed specifically for a relationship, then absolutely not. Tinder should really change their model to something similar to eHarmony though as the current model is causing issues that will get worse over time.

I've never thought of Tinder as a hookup site/app. Of course it can be used like that because sex comes with dating but its supposed to be a date site first. Sex is optional. And I speak as someone who has used actual hookup apps. Where its sex first and anything else is optional. The opposite of what Tinder is supposed to be.
