"Tropic Haze has not only agreed to pay $2,400,000 to Nintendo but also said that Yuzu was primarily designed to circumvent and play Nintendo Switch games and agrees to be permanently enjoined from working on Yuzu, hosting Yuzu, distributing Yuzus code or features, hosting websites and social media that promote Yuzu, or doing anything else that circumvents Nintendos copyright protection.

Oh, and it will surrender the yuzu-emu.org domain name to Nintendo, agree to delete not only its copies of Yuzu but also all circumvention tools used for developing or using Yuzusuch as TegraRcmGUI, Hekate, Atmosphre, Lockpick_RCM, NDDumpTool, nxDumpFuse, and TegraExplorer, and hand over any physical circumvention devices and modified Nintendo hardware to Nintendo. It also agrees to not delete any other evidence that infringes Nintendos IP rights."

The Yuzu devs were doing some dumb shit (that the ryujinx developers aren't) which opened them up to be a target

This, I think ultimately that was one of the bigger contributors to why they settled this fast. Yuzu only shot themselves in the foot for taking patreon money and giving specific instructions to pirate games, which I think is the biggest reason why Nintendo went after them and not the other emulators. There's etiquettes for this type of stuff and they broke it imo.

The rules seem clear.

  1. No commercialization or paywalls, likely no donations
  2. Make sure any decryption methods or firmware are wholly separate and inaccessible from the project
  3. Don't entice people to break street dates

They were charging on Patreon and considering how fast they settled, Im guessing they were using some of Nintendo's code as well.

Ultimately I think that's the Legal Team at Nintendo's goal, to get a precedent to allow them to go after all emulators. The only reason emulators can still exist is because of "technicality's", basically a grey area in the copyright laws.

The money is far secondary to Nintendo than making Yuzu stop and sending a statement.

Also I'm guessing that Nintendo, despite having a better chance to win than lose, still found the chance of losing a bit too high for its taste, especially given the standards a loss could set.

I think people were saying they were giving people step by step direction on their discord or something. I'll fully admit, I didn't fact check this claim I just remember someone posting this part of the information here.

They were not charging people money. Unless the Patreon offered early releases of the emulator? I haven't looked into it that much. But the emulator was definitely free to download.

I feel that it's more likely they felt it would be better to just not spend the money + time to go to court. Even if they got more out of it the court process takes ages and their lawyers have better things to do. And if the goal is to send a statement (of which I agree was the bigger point) then whether or not it actually makes it to court isn't needed.

I could understand being upset if this were a SNES emulator, but the Switch is Nintendo's current piece of hardware. Of course they're going to shut down an emulator of a console you can still get in stores.

Isn't some of this stuff necessary for getting homebrew working on a Switch? Losing all of that stuff would suck for people who just want to use mods and back up save files, even if they have no intention of pirating anything.

It's unfortunate, but this is how intellectual and copyright law works.

I am certain if someone came up with a tool to back up save files ONLY or that could make mods work ONLY if you have a paid copy of the game somehow... They won't go after you and probably couldn't. You aren't potentially peeling away profits from shareholders so why should they?

People think these companies slap these suits to be mean jerks or because they hate you personally for using emulators... but it's always the bottom line. It's because corporations are legally entrusted to maximize profits for shareholders. If news of a big console emulator starts catching buzz, they have to act or they could be voted out for dereliction of duty... but that's less emotional and more rational.
