"Squatting" needs to be renamed to what it actually is. Breaking and Entering sprinkled with some Trespassing. Screw those pieces of shit. They don't deserve rights.

Everything about this seems like squatter ragebait. Like, yes, it's bad and they should be punished to the fullest extent of the law, but, even without doing a quick bit of searching, I'm certain he's misinterpreting some law and that they will not get away with murder.

Doesn't sound like she was a landlord. She was the inheritor of a family property that was supposed to be uninhabited. Also, squatters don't have a landlord tenant relationship. By definition, a squatter is a trespasser. Not someone an owner of a building agreed to let stay there

Lets see ...
We got a 52 years old woman that lives in Spain.
Her mother lived in NY and died a few months ago.
So she travels to NY and is going to prepare her late mothers apartment because she is going to give it away to a friend of the family, and gets beaten to death by two squatters.

...and you start with this landlord BS?

So what's the origin or idea behind the "squatters rights"? What is it intended to protect, because I can't imagine it's intent was to protect those who broke into empty homes and just live there with no one knowing they're there

I think its basically to allow people to take over buildings that were legitimately abandoned and then give rights to the people maintaining the building after the original owners abandoned it. Like abandoned for extended periods of time or perhaps permanently abandoned

but yeah, any time its applied to buildings that arent abandoned its atrocious

She can get them evicted. They are still squatting. They don't own the property. But she needs to give them 30 days. After that it's like anyone else.

Thanks, I can see that. But homes of deceased relatives that people haven't gotten around to selling after only three months should be excluded. I thought I saw in another topic that just being there for 30 days gives you those rights

False, 95% of squatters are people the were are some point given permission to live there, but that permission has been retracted.

The story in the OP is a case of murder, not a squatter's rights issue.

LSGW covered this extensively in the other topic:
LSGW_Zephyra posted...
Nobody is stealing anything. They would need to live there 10 years before they could think of taking possession of it. They are claiming to be tenants. In which case, if they can't produce a contract then it is considered a month to month lease (iirc) and they can be evicted within 30 days.

Again, this is an inconvenience for the homeowner but if the squatter doesn't have a place to live, this could be life and death for them. If this drags out longer then that period because the courts are notoriously slow, then that's on the courts and not on the people inhabiting the house.

Ironic they described it as "life or death"

To not be evicted immediately. You have to give them time to move out. It's a good system that makes sure land is in use and homeless and poor people have a place to go instead of living on the streets which nobody wants.

The usual issue is the bureaucratic system that takes months to resolve and rule against the squatters.

Yeah, I agree with that. Squatters rights after 3 months is insane let alone 30 days. I think it should be a few years at least. To account for say, someone travelling the world for a few months or working overseas for a year or two etc

No ones saying they wont be charged. But having inherent rights to property certainly complicates the issue more then it needs to.

I'd like to also remind people that these laws and the bureaucratic headache exist because landlords suck. The vast majority of people this applies to are people who landlords are trying to kick out without giving notice and to prevent abuses like that. These laws protect a person so that they always have at least 30 days to find a new home which is often not a ton of time to have to clear things like background, credit checks on top of finding an affordable arrangement.

These laws act as a buffer to reduce houselessness which generally speaking, society rightly considers to be worth doing even if that means some individuals have to deal with he headache of a squatter.

Shit like this, reporting it as news the way they do only exist to get you to try to dial back the laws so that landlords can do whatever they fuck they want.
