Sure, however the fable still goes that Yahweh personally dictated the commandments, meaning that if we take the story on its merits then it would still be Yahweh protecting their ego.

I see it as serving both, and the fact that "don't murder" comes after honoring thy mother & father doesn't speak well for either man nor deity.

So the funny thing about the Ten Commandments is, the ones people are familiar with aren't even the "official" set. Moses destroyed the commandment slates when he saw the Isrealites doing the whole golden calf nonsense, so God had to whip up a fresh batch, and of course the first ten (I saw "first ten" because there's around 600 or so commandments but people only care about the first ten) of the new set don't match the first ten of the first set at all.

Most of the Courts conservatives appear content to ignore the Establishment Clause altogether. Justice Clarence Thomas, on the other hand, is thinking a little bigger. For about two decades, Thomas has bandied about the idea that the Establishment Clause should not apply to states at all. That is, were a state so inclined, it could establish an official state religion.

The argument is rooted in some version of history: At the time of the Constitutions ratification, states could (and did) establish their own religions. The Establishment Clause served two primary functions: First, it prevented Congress from establishing a federal religion; second, it prevented Congress from interfering with established state religions. This formulation prevailed until the ratification of the Fourteenth Amendment in 1868, which ultimately resulted in most of the provisions of the Bill of Rightsthe Establishment Clause includedbeing applied to (incorporated against, in lawyer-speak) the states. Since then, courts have held that neither states nor the federal government may establish a state religion.

The text of the first amendment starts with "Congress shall make no law." What if the court rules that "Congress" refers only to the federal legislature?
