Patrick Phinn, 49, stabbed Ronald Pattison 17 times at his home in Easterhouse, Glasgow, in September 2018.

The High Court in Glasgow heard that Pattison, who had a knife, had threatened to kill Phinn and his partner.

A fight broke out and Phinn grabbed a knife which he used to stab Pattison.
He was originally charged with murdering the 38-year-old, but a jury found him guilty of the reduced charge of culpable homicide.

Lord Matthews told Phinn: "It is difficult to think of circumstances where provocation is more appropriate than this.

"This was extreme in the circumstances.

"However, the jury was satisfied that you went beyond what was necessary."

In a life or death panic scenario where you are wrestling with someone trying to kill you, 17 times is hardly anything.

If someone breaks into my home and threatens me and my family with I knife I'd do my damnedest to make sure they are incapacitated. It's why cops unload their guns into someone. It's to make sure the threat is neutralized so they can't harm anyone else. It's possible they went to far, but how do we know it didn't take that many to incapacitate the man?

This is a dumb take.

When someone comes into your home, threatening to murder you, then you stab them until they stop moving. That will usually be when they're dead or dying.

Also, 17 isn't that many times to stab someone in a fight for your life situation.

Punishing this guy for defending himself is shameful.

It would seem so on the surface, but I bet if you or I were defending ourselves from an intruder we'd be shocked at how many stabs it took for them to go down.

If a guy threatens you and someone you love with a knife inside your home after breaking in, you can fucking Kamehameha Wave them for all I care. I would've voted not guilty. But I can still understand the jury's decision in terms of excessive force. If you have a guy restrained and then keep stabbing, you've probably gone beyond defense.

people sayin 17 times is a lot don't know what the hell they are talking about it. It's not uncommon for a person in self defense to unload an entire 10-20 round magazine into a guy. Furthermore, if someone is hopped up on drugs, you'd be amazed what you can survive.

So, if this was true self defense, this man is innocent and serving jail time, because you know, thanks liberals for your insane self defense laws that protect the invaders.

In self defense, this should almost not exist. If a person beats the attacker to the point they cannot fight back and then proceeds to smash their face in, sure call it manslaughter. But in any other case? Nah it should be self defense, period. You shouldn't be able to excessive force defend yourself unless the attacker is rendered unconscious/immobile because quite frankly you don't know if the attacker has a hidden gun or knife or something you aren't aware of or if they are high on drugs and adrenaline.

You have zero business entering another person's home uninvited. They don't know if you have a weapon, if you're hopped up on meth, whatever.

Unless the burglar flees immediately upon seeing/hearing you, I feel like it needs to be treated like a life or death situation in most every case. Should you ask them politely to leave, call the police and then wait patiently for them to arrive and hope you haven't been mortally wounded in the meantime?

Its like shooting a fleeing suspect in back...If your life is no longer in danger and you're able to get to safety, you do that. You don't continue stabbing the guy until he's dead...And I'm just gonna go out on a limb and say it didn't take 17 stabs to simply immobilize the guy so....

17 stab wounds will tell you nothing unless you know where and how deep the wounds were. Did he manage to gash a shoulder, a wrist, a collarbone? Once you fight back against someone who's already threatened to kill you, you don't stop at that. Not if you want to be sure of staying alive.

People have killed intruders in the UK before and gotten away completely free. The cases where they get time are usually like this or where they chase after the intruder afterwards.

I've been stabbed

I've been in life or death situations.

There is no reason to stab someone 17 times who is already incapicated. Emotions is an excuse.

I mean maybe a small child can get away with that but an adult can't.
